i am not a legal scholar, just a layperson. so i don't know if it's too lenient, but it is definitely more lenient on white people and more harsh on blacks. that does explain some of the discrepancy we see. other things also explain it.

Much easier to catch a murderer who left finger prints behind than an insider trader using dark pools to make trades illegally.

Honestly Red, Black people do not have a propensity to commit crimes, its the nature of the crimes and the attitudes of people towards those crimes that gets the brunt of police resources spent on them and therefore you end up having blacks be arrested more often.

i honestly never actively considered that aspect to explain the discrepancy between arrest and incarceration rates. i just figured there was nothing about skin color that made a person more or less inclined to crime.
