There are 4 safety features, and #1 is for all guns.
No round in the chamber and hammer down.
Next is hammer down on a live round.
Then cocked and locked with the safe switch engaged.
For my 1911 Colt Commander, there is the left side thumb safety, the hammer position, and the integral grip safety.
So, if he didn't have the hammer back, he didn't say so. And so the fool was carrying to shoot his ass off.
I imagine, but it was never questioned, that Zim had the hammer down on a round and cocked the weapon to shoot.
He just lied in omission there, again, I think. Of course, the facts show he is quite the fool....

Me thinks the fool in this post is not Zimmerman. The Keltec has NO EXTERNAL HAMMER. Zim could not have had the hammer down, or up, or in between. The Keltec is a full double action. You pull the trigger, and as you do the internal hammer is lifted until it trips at its extreme extension and then the gun goes bang.
It's really very technical and complicated and probably requires 16 hours of training to fully understand the process, so don't feel bad that this is all going over your head.

A better question would be: what fool carries an unloaded gun, and for what purpose?
An unloaded gun is just a very poor club, you would be much better off just carrying a ball-peen hammer than an unloaded gun.

So, being a double action it lifts the hammer, (all guns have hammers,) and drops it with a single long hard, pull of the trigger.
It is like my double action S&W revolver but can't be hand cocked. I don't don't carry that with 6 rounds. I have only 5 in and the hammer down on an empty. It has a solid firing pin, unlike the 1911.

IMO, It's consistent with how a layman would describe a pistol without an exposed hammer...
Even if he chambered a round, so what? it's works for either side, for the defence it serves in reinforcing he was scared, for the prosecution it serves to prove intent... Either way not damning in and of itself...
