3. When the killing is committed by accident and misfortune resulting from a sudden combat, if a dangerous weapon is not used and the attempted killing is not done in a cruel and unusual manner.

So, it is excusable only if there was no "dangerous weapon?" Yet it is justifiable, regardless of the weapon?

So, in both 2nd and 3rd Murder, it seems to be the difference, (a slim difference, here,) between sudden combat vs attempt to murder.

I say then, sudden combat with a dangerous weapon used to end it is not a justified nor excusable killing and therefore un-lawful.




Andrea Sniderman looks like a real nut and that trial is up next. :)

And the Sniderman case is not for everyone. You have to be a little twisted to get entertainment out of that trial. its right up my alley

The content of the "toon" caught me off guard as the Herald is known to be somewhat left bias ~ and ~ they seems to be poking at other world media sources.

I pretty much agree, believe it or not. I think Z ought to be acquitted, reasonable doubt and all, but who knows what the jury will do. I think the prosecution did a good job of cluttering the trial with an appeal to emotions with the closing by attorney Guy. On the other hand, I doubt there that isn't at least one juror who is willing to set aside the "poor murdered child" appeal and look at the cold, hard facts.

I think the jury will acquit on murder 2, and hang on manslaughter, even though the reasonable doubt is exactly the same for both charges. If there is a tilt toward a verdict then the tilt has to be toward acquittal.

Predicting juries is not a safe practice though.

Keep beating that drum, Buck, even though it is in tatters. The actual evidence presented at the trial leaves nothing but reasonable doubt though. The fact is, charges never should have been filed and would not have been filed without the political pressure applied to Serino and the police chief by the usual suspects to appease the mobs.
