If there was a sound of him "cocking a gun" that would mean there wasn't a round in the chamber.
Actually it depends. Lets say that before you load your mag into the gun it is sitting in the locked open position, you press the slide release and as soon as you do that the mag feeds a round into the chamber. If you load while the firearm is in the closed position, you have to rack the slide to feed the round into the chamber. But, most anyone with a carry permit already has their firearm locked and loaded and depending on the firearm, it has the safety on. No one I have ever met or spoke to would walk around without a round chambered, it really defeats the purpose of being "ready" when the time arises. I mean, you could just chamber a round real quick if you needed to, but lets just say for the sake of when Z shot M, in that kind of situation, you would want to have the round chambered already. Not to say that he couldn't have done it before hand, but I seriously doubt it happen that way, and if it did, it's still justified for his safety, because he could have been attacked at any moment while walking down that path.
