People V. Carruthers -CoA Rules Marijuana Extracts Illegal

(k) "Usable marihuana" means the dried leaves and flowers of the marihuana plant, and any mixture or preparation thereof, but does not include the seeds, stalks, and roots of the plant. I believe the wording "preparation thereof" does allow for medibles, oils, and tinctures etc. Many items are a preparation of something that doesn't remain in the end product, coffee and tea are perfect examples of this. When a cup of tea or coffee is prepared the plant matter is removed, nobody is expected to drink coffee grounds and tea leaves. I believe when this law was written this was the intent to allow for these things. I hope the supreme court will see it this way.

I agree Thats what I was thinking when I cast my vote. MMJ was WHY I registered to vote, I hadn't voted in years prior, for any reason.

This "decision", is like saying that ...ok, you can have a Coke, that's fine, you can have a glass of water, choice is yours, but if you make an ice cube out of that water and put it in your coke,................................. YOU"RE GOING TO JAIL!!! :fire:

Right better change the way you dry your plants if you do not hang the whole plant........... Seems like ANOTHER reasonable compromise........ Right?????? I mean it's just one more sacrafice of our section 4 card protections...... What's one more???????? Edited to add..... But hey look at the bright side as someone once pointed out to me that the card is still good for scraping some of that non protected hash. Ohhhh wait... I heard they are going to change the card design...... Cant let one slip between the cracks... If ya know what I mean?

So I ask again how is the thc and trichomes NOT PART OF THE FLOWER AN LEAF????????

I was thinking the same thing ozz. As it stands I cut branches off of the plant and hang them to dry like that. That's going to change next harvest. I'm hanging the whole thing in tact now so that I can prove how many plants (not "usable marijuana" so they must be considered a plant) I have.

What a gong show.

Like calling a cutting a plant. It's not a plant, it's a fucking branch...yank...see? no roots! Take it out of that humidity dome and it's dead. It's not a plant until it can survive against the elements on its own, by nature apart from mankind. Stop fudging my plant count!

Thats something I've always thought needs to be clearly written into the law. The law should state that it needs to have roots to be considered a plant.

Don't invite the pigs over for breakfast and a couple dabs and I think most of us will be okay. Unless you're moving the shit on a large scale or you get caught with it in your car, there's little to no risk for the average patient / caregiver. This will inevitably be sorted out when it goes the the Supreme Court, as the rationale the appeals court used in the decision making process was suspect at best.

As always, stay low key and stay under the radar; stay out of the dog cage.

They aren't all pigs. You're known by the company you keep, and if they are police us, they should first police themselves, but they put their pants on one leg at a time too. A lot, probably most of the time when they give you bullshit, their hands are tied.

Amazing the list of terms and definitions associated with the act and simple shit like "plant" aren't defined. Guess that's how it is when the pricks make you write down everything that is now LEGAL instead of listing the few instances where something is ILLEGAL. very few things are done that way. like saying define all instances where a product transfer is legal instead of defining what theft is.

The number of times in the 70's when a cop dumps a bag of pot out and says go on home now is much higher than today. anecdotal obviously and not measured but I don't buy tied hands for a reason to fuck with a guy over that shit. Hands are tied is a universal excuse used by authority to be dicks and take no responsibility for their actions. mandatory suspension for a weapon at school and they "can't do anything" about a kindergartner taking a plastic knife to school for lunch to cut a samich? bullshit, you don't want to make a judgement call, even though that is the job of the authority in power. its a universal problem and I don't accept the excuse. good guys to put on the uniform, I will admit this much.

I get it really, these reasons are among those which made me decide not to become a cop. I can't, and won't take an oath, and then break it, and I've never met a cop that took their oath seriously. I think people should be held to their oaths under penalty of death.

I have been politically active and in close contact with the police for years. What I have learned, is that cops are cops. They have their own society like a parallel universe to ours. Some are worthy of medals on their chests, some are worthy of metals in their chests. They are human beings, and if they fail, it's with the same human frailties that make us all fail. Likewise when they succeed.

Once upon a time, I got raided, and this cop was going to take my bowl. THis wasnt an ordinary bowl. Me and my X g/f wanted a real bowl that we made, not some store bought thing. We cut down a tree, an oak, we dried the branches and selected one to make into a pipe. In the months and months it took to cure the branch, (to keep it from cracking), life happened, and we wound up living in a car in S. Carolina at a boat launch. With nothing but time on our hands, we started carving this bowl. We got a place in W. Virginia where the only heat was from a wood stove. We took a coat hangar and a hot iron from the wood stove, and burned the bowl part out, and then burned all the way through the core from the mouthpiece to the bottom of the bowl. During this time, the people we were living with got to sniffing pills, grabbed a 12 gauge, and decided they wanted to rape my g/f. Long story short, they failed at the rape, I took several beatings, and escaped through answer to prayer. We had to run in the middle of the night, crossed a river, and banged on someones door to get to a phone. All we had was the clothes on our back, which were now soaked, and 2 bowls. Woody, which wasnt finished yet, and Oceans, a pretty little glass piece. The cops came, and wouldnt do anything about these people (they were the local dealers and everyone was in on it. They cant bust the dealers, it would wreck the economy. They feed the courts one once in a while to keep things legit. Anyways, at 4:20am we are in a cop car with these bowls in our pockets, and they took us to a hotel that the Salvation Army paid for the night. That was it. I called my dad, explained it to him, and he reluctantly agreed to come and get us, but had to wait a week in the hotel. He set us a grand, we paid the motel got food, clothes, and I bought some sandpaper and stain. Needed something to do anyways. We sanded and stained this bowl, no power tools were ever used on this piece, even the tree was taken with a bow saw. This bowl, needless to say, is priceless to me. One thing is certain, I will never again be without a handgun, even at home . Anyone who doesn't simply doesnt have a hold on what can happen to you even at home. Thats where we were.

During this raid, we told the police this true story about Woody. He put it in the kitchen drawer, closed it, and continued writing the ticket, and bagging up all of our other paraphernalia and a small bag.

That cop deserves more than I could ever repay. I still get a little misty eyed.

I have known several cops that were like this guy. I also have 2 cases on my record for assault and resisting a police officer. I guess thats because I take people as individuals.

...sorry, I couldn't resist. I have met a few and I do mean less than a handful of officers that I can respect, but for the most part they really seem to abuse their powers. Worst of all, they're always hiding behind tort law and when they do get their dicks in a wringer, it seems they are never get real punishment. Only let go with no permanent marks on their record. (may as well be an accolade for the wrong doing) It just disgusts me when they're clearly in the wrong and all that happens is more or less a transfer, much lie a priest pedophile.
