People V. Carruthers -CoA Rules Marijuana Extracts Illegal

somebody help me out here, if this is what the MI law says where is the argument?

(3) “Marihuana” means all parts of the plant Canabis sativa L., growing or not; the seeds thereof; the resin extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant or its seeds or resin. It does not include the mature stalks of the plant, fiber produced from the stalks, oil or cake made from the seeds of the plant, any other compound, manufacture, salt, derivative, mixture, or preparation of the mature stalks, except the resin extracted therefrom, fiber, oil or cake, or the sterilized seed of the plant which is incapable of germination.


I know this has probably been brought up, but I'm just feeling on the war path this morning.

(e) "Marihuana" means that term as defined in section 7106 of the public health code, 1978 PA 368, MCL 333.7106.

So much of this legalese and parsing of words, or "letter of the law" within our criminal justice system over the past 7 years have effectively render our medicinal law (MMMA) mute at will as it relates to protecting patients and caregivers from the substance criminalization it was designed and voted on to do ("spirit of the law") .

How the simple basis of our rights/the law and it's clear disregard by LEO and criminal courts have not become a topic of a major legal case is beyond me:

"4. Protections for the Medical Use of Marihuana.

Sec. 4. (a) A qualifying patient who has been issued and possesses a registry identification card shall not be subject to arrest, prosecution, or penalty in any manner, or denied any right or privilege ..."

Where is the wealthy individual with legal resources equal to that of the state and the legal standing to sue for the reality and rights granted by MMMA? We would not need to rely and wait on this theoretical person if there truly were any "equality under the law" that is fraudulently sold to us for conformity.

Carruthers is an excellent example of the corruption of our criminal "justice system" bankrupting a defendant to ensure they do not become a plaintiff in a civil court suing for the clear entrapment and other criminal actions of LEO as suffered, no less all of our MMMA rights in general.
