Trump seeks stay of gag order in Jan. 6 case
Former President Trump’s legal team asked a judge Friday to pause her gag order limiting his speech in the election interference case while he appeals the decision.

“The Gag Order violates virtually every fundamental principle of our First Amendment jurisprudence. It imposes an overbroad, content-based prior restraint on the leading Presidential candidate’s core political speech,” Trump’s attorneys wrote in the filing.

A Monday decision from Judge Tanya Chutkan bars Trump speech that “targets” foreseeable witnesses in the case, lawyers on the case including prosecutors and court personnel.

It does not bar Trump from criticizing President Biden, campaign rival and former Vice President Mike Pence or the Justice Department and his prosecution in general.

Trump filed a notice of appeal with the D.C Circuit Court of Appeals earlier this week, though it has yet to make any legal arguments in that case.

The 33-page filing on Friday asks for Chutkan to address his request by Tuesday, noting any denial would result in him seeking an emergency stay from the appeals court.

While Trump’s appeal of the gag order has yet to begin in earnest, Friday’s push for a stay offers a preview into how he plans to fight the limits on his speech.

“Given its extraordinary nature, one would expect an extraordinary and compelling justification for the Gag Order. But that is conspicuously absent. Instead, the Court generically states it must enter the Gag Order to prevent supposed ‘threats’ and ‘harassment,’” Trump’s team wrote.

Chutkan noted in her order that it was undisputed that Trump’s social media commentary and campaign rhetoric were leading to real threats for his targets, noting that he has even called for the death penalty against some expected witnesses in the case.

But she did not use the Justice Department’s suggestion that she limit speech that was derogatory or intimidating, settling with barring him from using speech to target certain individuals. It’s a more elastic phrase, one that could leave the door open for Trump criticism.

And Chutkan also did not bar Trump from attacking Washington, D.C. — something prosecutors worried could poison the jury pool.

In court, and again in Friday’s filing, Trump’s attorneys focused on his status as a president and how the order could impact his campaign.

“It prevents President Trump from discussing core political themes that are central to his campaign message and prevents him from criticizing speakers who are openly criticizing him in campaign events, media appearances, public statements, and even books,” they write.

“By restricting President Trump’s speech, the Gag Order eviscerates the rights of his audiences, including hundreds of millions of American citizens who the Court now forbids from listening to President Trump’s thoughts on important issues.”

Chutkan said earlier this week that Trump’s status as a candidate does not mean he has unfettered rights to speech.

“First amendment protections yield to the administration of justice and to the protection of witnesses,” Chutkan said at a Monday hearing to weight the matter.

Wait until he finds out he has Chutkin for the civil rights case. The gods are not smiling on him.

A New York judge fined former President Trump $5,000 Friday after a derogatory post about the judge’s principal clerk was not removed from the 2024 candidate’s campaign website, despite a clear order from the judge.
Judge Arthur Engoron did not hold Trump in contempt of court, but he warned further violation of the gag order he imposed after Trump’s Truth Social account made the post could result in serious punishment, including steeper financial penalties, contempt or even jail time.

Donald Trump has received ample warning from this Court as to the possible repercussions of violating the gag order,” Engoron said. “He specifically acknowledged that he understood and would abide by it.”

“Accordingly, issuing yet another warning is no longer appropriate; this Court is way beyond the ‘warning’ stage,” he added.
The post, published on Trump’s account while he sat feet away from the clerk, derided her as Senate Majority Leader Chuck Schumer’s (D-N.Y.) “girlfriend” and included personally identifying information about her.
Once Engoron became aware of the post, he issued a limited gag order barring Trump or any other party in the case from posting or speaking publicly about members of his staff. He also ordered Trump to delete the post, and while it was removed from his Truth Social account, it remained on his campaign website for 17 days.

In court Friday, Trump lawyer Chris Kise blamed the “very large machine” of Trump’s presidential campaign for allowing his deleted social media post to remain on his website, calling it an unintentional oversight.
Engoron acknowledged Trump’s assertion that the post staying up was inadvertent and said he would give him the “benefit of the doubt.”

However, the gag order was still violated, he said, warning that in the “current overheated climate, incendiary untruths can, and in some cases already have, led to serious physical harm, and worse.”

Trump, the Trump Organization and the former president’s two adult sons — Donald Trump Jr. and Eric Trump — are on trial in Manhattan after New York Attorney General Letitia James’s office filed a lawsuit against them last year alleging decades of fraud. It claims the Trump Organization falsely inflated and deflated the value of its assets to receive lower taxes and better insurance coverage.

Trump has denied any wrongdoing, describing the case as a politically motivated “witch hunt” and both James and the trial judge as biased against him. His repeated attacks against them echo the attacks he has lodged against judges and prosecutors in his other cases.

U.S. District Judge Tanya Chutkan issued a limited gag order earlier this week against Trump in his federal case over efforts to overturn the 2020 election after the former president made similarly inflammatory remarks about people tied to that case.

Judges getting murdered over court cases makes many in the justice system and DOJ take notice and Trump has no shortage of violent lunatic supporters. Inciting them to acts of violence or doxing court officials might be seen as more of a threat in the wake of this murder.

One could certainly make the case that Junior violated the Judge's order and ignored his warning. This post disparages the judge by accusing him of committing ethical violations of the Judicial Code of Ethics by doing the bidding of a political PAC. If true, that would result in the removal of any Judge from the bench. In fact, the Judge was simply made aware of what was reported by a media company, not a political PAC. But now, Junior has accused the Judge of breaking the law and committing serious ethics violations."

Will he get a jail spell before his loving daddy?

I believe the judge in NY did not single out Donald, but the order applied to all defendants and participants in this particular case including Don Jr and Eric who are also part of the tax fraud case in NY....
