87,930 views Sep 7, 2023 Lights On with Jessica Denson
The strongest lawsuit yet to enforce Trump’s disqualification from holding office under the 14th Amendment has now been filed in Colorado by Citizens for Responsibility and Ethics in Washington (CREW). CREW co-counsel and Colorado attorney Mario Nicolais joins Jessica Denson to discuss the very real impact the lawsuit aims to have in barring Trump from the ballot.

Trump notifies judge he may try to move Georgia case to federal court
Former President Trump on Thursday signaled he may attempt to move his Georgia charges to federal court.
“President Trump hereby notifies the Court that he may seek removal of his prosecution to federal court,” Steve Sadow, Trump’s attorney, wrote in court filings.

Legal experts have anticipated Trump would make such an attempt, but Thursday’s filing provides the strongest signal yet that he plans to do so.
Trump still has multiple weeks to officially file his request. Under federal law, his request must be filed within 30 days of his arraignment. Trump pleaded not guilty and waived his in-person arraignment on Aug. 31.

Legal experts agree moving the charges still will not make them subject to a presidential pardon but that it would change the dynamics for Trump’s case.
If successful, Trump’s case would be overseen by a federal judge, and the jury pool would be drawn from a broader area of northern Georgia that is less heavily Democratic.
And while the state judge has indicated the trial will be televised, moving to federal court would likely prevent any of the proceedings from being broadcasted.
Trump wouldn’t be the first co-defendant in the case to mount such an attempt.

Multiple of Trump’s co-defendants in the case have already begun trying to move their charges, most notably former White House chief of staff Mark Meadows and former Justice Department official Jeffrey Clark. Three pro-Trump individuals charged with signing documents purporting to be Georgia’s valid electors have also made such a move.

Some legal experts believe if any of their efforts are successful, Trump and the other co-defendants’ charges would be automatically moved.
The co-defendants are attempting to make the move as part of a two-step process. If granted, Meadows and others are hoping to assert constitutional immunity to have their charges dismissed.

The dispute over moving courts rests on three prongs: The defendants must show they were a federal officer, that the allegations relate to an act taken “under color of such office” and that they have a plausible federal defense.

Trump’s filing Thursday comes after the state judge signaled he plans to issue a schedule for Trump’s case by next week. But the judge has cited the co-defendants’ efforts to move their charges as one reason that prosecutors’ proposed timeline to try all 19 in October is likely too ambitious.
Trump previously tried to move his charges in his hush money criminal case to federal court, but a judge rejected the move. Trump is now appealing that ruling.

MAGA Supporters Have Idiotic Plan B If Trump Is Banned From Ballots

Supporters of Donald Trump aren't too scared about the thought of having their cult leader removed from 2024 ballots using the 14th Amendment because they have come up with a "brilliant" plan to circumvent that little issue. If Trump is banned from the ballot, they are planning on just writing him in as their presidential choice, because apparently they don't understand what the 14th Amendment actually says. Farron Cousins provides these MAGA morons with some knowledge about how the Constitution works.

Why the 14th Amendment could boot Trump from ballots (and why Democrats might not want it to)

Former Senator Claire McCaskill outlines the terms of the 14th Amendment that would bar Donald Trump from appearing on election ballots because of his role in trying to subvert the 2020 election, and considers the significance of the politicized Supreme Court as the final arbiter on the matter, as well as whether Joe Biden would prefer not to have Trump removed from the election so he can beat him again.

I've been saying all along that Loser45 being the R candidate is Biden's, and subsequently all D's, best chance of winning. I think even more people who don't usually vote will do so just to vote against the X than the last time.
Funny how X likes to brag about getting more votes than any other sitting president, in a losing effort. Naturally, he won't mention he still lost by over 7 million votes.

He fucked up everything he ever did including his run for president, which was a publicity stunt gone bad, he never expected to be elected and was shocked when he did, this has been widely reported. In 2020, he tried to win, needed to win and failed, he would likely fail again because he is actually trying to win again. He is too great a risk and the polls are too uncertain to allow him to run again, the constitution must be enforced, and the 14th fits him like a glove. When it will be enforced against him is the question, not if, the 14th is clear, the federalists agree, and I can't see the liberals on the SCOTUS disagreeing. The case in Colorado appears to be the best chance considering their state laws and the papers by CREW and 6 plaintiffs have been filed with a democratic secretary of state.

Trump hosts fundraiser for Giuliani
Former President Trump hosted a fundraiser for his longtime ally and former attorney Rudy Giuliani on Thursday night, as the man once known as “America’s Mayor” struggles to keep up with his mounting legal bills.

The $100,000-a-plate fundraiser at Trump’s Bedminster, N.J., golf club was expected to raise more than $1 million for the former New York City mayor, Giuliani’s son, Andrew, said. Trump has also committed to hosting a second event for Giuliani at the former president’s Mar-a-Lago estate in Florida, Andrew Giuliani noted.

“So that will be very helpful,” Giuliani’s son said on WABC radio. However, he added, “It won’t be enough to get through this.”

Giuliani’s attorney, Brian Tevis, similarly suggested Thursday that the former mayor is likely trying to raise “as much as possible,” adding that he thinks “they’re going to need it.”

Giuliani was indicted last month alongside Trump and 17 others in Georgia over efforts to overturn the results of the 2020 election in the Peach State.

He also faces defamation suits from two voting equipment companies and a mother-daughter duo of election workers whom he accused of manipulating ballots, in addition to proceedings in New York and Washington, D.C., to strip him of his law license.

Do you think sexual favours were involved?

I don't think Trump can win in 24 either. It might be best for this country if the voter decided instead his political fate being decided by some Trump appointee behind a bench. I've also heard Republican analysts claim that any other Republican candidate could beat Biden. Then again, why would they hurt their future earning power by pissing off providers of their gravy train?

But I don't think we should play politics with the Constitution. Republican leaders in 1866 were exactly right when they took action to prevent former secessionists from gaining access to power in the reformed US by enacting the 14th. This was later proven correct when they backed off and let them back in power in 1877. 140 years later, we are still afflicted by that same plantation society. They were right to suppress illiberal tendencies of the wealthy class. I'm for Democracy. Voters should decide who will lead us. Except those who previously acted to overthrow our Constitution.

If Trump gets a pass on this, then what does that tell someone in the future that pulls the same stunt but better?

I don't think Trump will get a pass on the constitution or the law and will be disqualified and convicted on all counts eventually and with perhaps more charges to come.

Exactly. Laws that are not enforced are not laws.

This could mean other people could be disqualified too. Every one of Trump's "special electors", every State AG and Governor who sued to overthrow the election and every co-conspirator in the WH and Congress could be found disqualified. They supported Trump after Jan 6. They should not be allowed in office. This could be a watershed moment for our democracy, rolling back the power of the antidemocratic forces that have gathered over the past decade who are intent on keeping power despite the will of the nascent post-2000 majority. That's my opinion. I have no idea how the courts will decide to make that decision but I can see how this could shorten the time to when MAGA is sent to the dustbin of history and send a signal to future fascists that the US does not tolerate their illiberal conspiracies. It just might give our Democracy another 250 years of breathing room.

Trump rips release of Georgia grand jury report
Former President Trump lashed out after a Georgia grand jury report released on Friday signaled that it had recommended charges for several Trump allies, including Sen. Lindsey Graham (R-S.C.).

“The Georgia Grand Jury report has just been released. It has ZERO credibility and badly taints Fani Willis and this whole political Witch Hunt. Essentially, they wanted to indict anybody who happened to be breathing at the time,” Trump wrote on his Truth Social platform.

The former president called Fulton County District Attorney Fani Willis an “out of control ‘prosecutor'” and made baseless allegations that she was working for the Justice Department.

The grand jury in Fulton County, Georgia weighed potential charges on a number of individuals in connection to an investigation spearheaded by Willis into efforts from Trump and his allies to overturn the 2020 election results in the state.

The report found that charges had been recommended against Graham, former Sens. David Perdue (R-Ga.) and Kelly Loeffler (R-Ga.) in addition to others, including former Trump national security adviser Michael Flynn and attorney Cleta Mitchell.

Nineteen defendants have been charged in total in connection to the probe, including Trump, former White House chief of staff Mark Meadows, former Trump attorney Rudy Giulliani, former Justice Department official Jeffrey Clark and former Trump lawyer John Eastman, among others.
All 19 have been arraigned, and the first trial date is set for Oct. 23 for defendant Kenneth Chesebro.
