Reporting from Chicago— Calling it a "tragically bizarre" case, an Illinois appeals court has ruled that a man killed by a train while crossing the tracks at a Chicago Metra station can be held responsible after part of his body struck and injured a bystander.


In 2008, Hiroyuki Joho, 18, was hurrying in the pouring rain with an umbrella over his head, trying to catch a Metra train, when he was struck by an Amtrak train traveling at more than 70 mph.


Several witnesses said he was smiling as the train hit him.

A large portion of his body flew about 100 feet onto the southbound platform, where it struck Gayane Zokhrabov, then 58. She was knocked to the ground, her leg and wrist broken and her shoulder injured.

A Cook County judge dismissed Zokhrabov's lawsuit against Joho's estate, finding that Joho could not have anticipated Zokhrabov's injuries.

But the appellate court disagreed. After noting that the case law involving "flying bodies" is sparse, it ruled that "it was reasonably foreseeable" that the high-speed train would kill Joho and fling his body toward a platform where people were waiting.

Leslie Rosen, who handled Zokhrabov's appeal, said although the circumstances were "very peculiar and gory and creepy," it was a straightforward negligence case, no different than if a train passenger had been injured after the engineer hit the brakes.

"If you do something as stupid as this guy did, you have to be responsible for what comes from it," she said.
If he doesn't pay, are they going to throw his ass in jail? He's in several pieces so that might be an option.

Kind of makes sense? He caused the accident. It reminds me of the Seinfeld episode where the guy jumps off the building and hits Jerry's car.

Sometimes an I jury like broken bones that the person sustain can cost too much money, and could financially ruin a person. I can see sueing if I couldn't afford the medical bills I had to pay after the accident. But if that's not the case it's a little fucked up.

A reasonable and detached examination of the FACTS paints a different picture entirely.

The woman sued the man's estate, not the dead man himself.

In a civil case, nobody goes to jail - dead or alive. :-P

This is a clear cut case of negligence. It meets the four requirements that a plaintiff must prove under the law in a civil suit.

That the man fucked up and got himself killed is irrelevant.

That his negligence resulted in harm to an innocent bystander is COMPLETELY relevant.

You sue the person to get some of his estate.

Don't worry, the dead guy won't have to go to prison in a civil case, I know you were worried about how that would make him feel.

Any idiot knows you weren't serious about that part, what you WERE serious about was how a dead person could be sued, now you know, don't take it as an insult.

It has already been pointed out that the ESTATE of the dead man is being sued. It happens all the time.

Which means your outrage is not based on anything rational.

Ok, am I the only person who thinks the woman should be suing AMTRACK for neglegence? They said the dead guy should have been able to.forsee hos.body flying and injuring someone, why then did amtrack.build the platform the way they did. If the dead guy can get sued for neglegance, how about the 70 mph train that caused his body to fly?

If I hit a baseball through your window, you dont ask the baseball manufacturer to repair your window do you? No. you ask the guy with the bat....right?

NoDrama has an ongoing hate fest going with me. It has ranged anywhere from homophobic hate comments to racial slurs. It's just a carry over from his constant attacks. Pay it no mind.
