The Michigan Supreme Court won't intervene in a dispute over a Grand Rapids law that makes possession of small amounts of marijuana a civil offense similar to a traffic ticket.

In an order released Saturday, the court declined to take an appeal from the Kent County prosecutor.

Justice David Viviano wanted to take the case, saying it raises a critical question over a prosecutor's "broad power to enforce state law."

Grand Rapids police officers don't have to report marijuana cases to the prosecutor unless they involve grow operations; someone has more than 2.5 ounces; or a person is caught committing another crime.

The appeals court upheld the law. It said Grand Rapids voters made the change by amending the City Charter — not through an ordinance. It's a critical distinction under Michigan law.

At some point these lawyers, courts and judges are going to have to get on the right side of history. In the past 50 years the reality of their "drug war" has damaged our society much more than their legal theory of drug addiction ever proclaimed to pose. This drug war is a war on us and it's time for the legislative and executive branches to stand up against the judicial branch before they erode respect for the rule of law and our government any further for their own self interests. It's time to hold them responsible for what they've done and are doing, fuck the bullshit of absolute immunity that they created and hide behind. Free my people, free all my people ...

Nice to read some good news for a change

They amended the city charter, not an ordinance. In the article, they mentioned that is a critical distinction. Why is this an issue?
