MMJ and Drivers License Revocations

I'm posting this as a PSA. Partly to warn people, but mostly to let as many people know as I can, that the government isn't any more willing to follow the law than the average convict. I'm trying to stay anonymous for obvious reasons.

I've never had drug or alcohol related charges on my driving record. I did get a reckless driving for which I lost my drivers license. I cant give the details, but there were no injuries, no victim=no crime. Just some BS ticket from a coward in costume jewelry.

I wrote my story out, and sent it to the MMJ freindly congress critters in Lansing, asked High Times to print it, send a copy to NORML, sent a copy to the Governors desk, and even sent a copy to President Trump. Still not sure about the guy, he's done a LOT of good, but most people have been convinced otherwise contrary to actual facts. I'm waiting for him to keep or break his campaign promises to the 2nd Amendment before I decide to love or hate the guy. So far, it's not looking good.

Anyways, here's my experience. At least what I can say here.

To whom it may concern,
I am thankful to live in a medical marijuana state, and have been proud to be a participant in the medical marijuana program. I have had wonderful, positive, life changing results from using marijuana as medicine.
I applied for the license to avoid being kidnapped and robbed for treating my own back pain without the use of dangerous prescription drugs.
I was warned by my friends against getting a medical marijuana license because of their distrust of government as a result of decades of abuse from law enforcement, CPS, gun licensing boards and the like.
My friends were right !
I should never have enrolled in the program. I am attempting to get my drivers license restored, and as it turns out, the Secretary of State and its review boards simply refuse to follow the laws of our state. They refuse to re-issue a drivers license to anyone who has a medical marijuana card, and it is nearly impossible for one who has had a medical marijuana card in the past. Had I not attempted to follow the law by participating in the medical marijuana program, I would have already gotten my drivers license back. There are several hundred thousand licensed drivers who have medical marijuana cards throughout this nation. Before I got my medical marijuana card, I would drive high everywhere, however I stopped driving while intoxicated when I got my MMJ card because I didn't want to lose it. Don't believe the propagandists who claim that legalization increases the incidence of intoxicated drivers. I would also not be paying a lawyer $4,000 to get my license reinstated. I am on SSI and disability, yet his fee is literally half of my annual income.
In hindsight, I should have just kept my mouth shut, never applied for a license for marijuana, and continued to do business on the black market through street dealers. Legally speaking, it's much safer.
As a direct result of such oppression that has caused the distrust of government, and a hatred for our police and courts. This type of oppression has also resulted in the decriminalization, re-legalization, and the medicinal use across the country, as the voters have become sick and tired of such abuses.
This is why the government has lost the war on drugs. Instead of using their power in the laws to fight crime, they've used them as an opportunity to fleece the public, and to increase their particular part of government.
You may use these words to help to train people, to establish or eliminate policy, to communicate with legislators, or in any other purpose in fighting against prohibition, to legalize, decriminalize, or to further correct the problem in our laws, or in the medical marijuana program itself.
I have sent this letter anonymously out of fear of retaliation from government for making my feelings known. We are not quite a prison state yet, but this has devolved into enough of a police state, that I am afraid to put my name and face to my opinions.

I got my DL reinstated after 18 (yes eighteen years) of it not being valid. Im also a legal med mj card holder. I didnt have any issues at all getting my dl back. Had to retake all the tests like I was 16.

And just a heads up, Michigan has started a pilot drugged driving stops in Michigan with "trained" officers to spot mj driving.

What evidence do you have to support your claim? I spoke with several lawyers who said the same thing. There was an appeals court decision about driving already. People vs Koon. They upheld the SOS zero tolerance policies against the MMMP.

Obviously. SOS has a zero tolerance policy for mmj. They don't care about the law, just like the ATF. It would e absolutely impossible for you to ever be wrong about anything. Best way to have the last word is to talk to yourself .

That violates a VERY specific line in the mmma of 2008. Something along the lines of "no right, privelage etc shall be denied etc etc." The use of the word shall is key there, meaning it is not a choice nor up for debate. Seems that would be a relatively simple case for a competant lawyer to argue right? Might I ask exactly how it is the sos knows you are registered wih lara? It is confidential for a reason and if you didnt tell them yourself..could be potential for a lawsuit maybe? Discrimination etc. Do you have it in writing from the sos ,the specific reason for declining reinstating hour drivers license? Forgive folks if they are skeptical..what you are suggesting is a pretty big brick to move man.

did they deny reinstating your license because of reckless driving ?

or because they specifically said you had a mmj card?

you are also mis-hearing about people v koon. people v koon said that the laws against driving with thc in your blood do not apply to mmj patients with cards. police have to prove impairment.

the MMMP is confidential, so no one knows you have a card unless you tell someone. further it means anyone who says you have a card is breaking the law.

you talked to the wrong lawyers if they told you they couldnt get your license back. talk to michael komorn komornlaw.com or greg schmid at http://schmidlaw.com/ good luck

I did bring up the law that says no person can be denied any Right Or privilege because of this card. I brought that up right in the hearing. The hearing officer told me, that only applies the building licenses and such. Simply put, the Secretary of State and it's minions do not care about the law. This is why I'm trying to tell you guys this . I was asked if I had a medical marijuana card I said yes because I was under oath and if I would've said no and they checked, which they will, I would've been charged with perjury. I hired a new lawyer , who said that even if I had a doctor supporting my use of medical marijuana, the hearing officer would not approve approve my license. I have a drug test coming up at December which I will submit to the hearing board and there is no for the reason that I should be denied. Make no mistake about it, the second I get my license back I will be smoking again. But not with the card. I smoked for years before they pass the medical marijuana law, I will smoke as long as I want to

Yes, if I had knowingly and intentionally committed perjury by saying no to the direct question of the hearing officer about my carrying a medical marijuana card, then yes I would've had my drivers license back

How can they check? We are protected from our names being shown to whomever asks for it. Just to get your drivers license back why would they even ask you about mmmp

If I'm not mistaking MMFLA grants full MMMA record access to law enforcement to perform their tracking/oversight role. 2018 will be a new era in "medical marihuana" in Michigan, like it or not ...

They say one thing and do another. They aren't following the law, and I have no reason to assume they would. Just look at the way the police prosecutors and courts have become, they don't even keep the oaths they take regarding the constitutional rights of people.

Oh ya, this began yesterday.

Beginning Wednesday, these five counties will begin the program with the Michigan State Police to conduct roadside drug testing for suspected drugged drivers. Avoid these counties if you are able. Odor is usually the first reason for suspicion. Refusal of the saliva test will result in a civil infraction (I have heard rumors of a $65 ticket). The saliva test would have to be confirmed by taking the suspected drugged driver to the hospital for a blood test confirmation. Remember your right to remain silent and call an attorney!
