I caught someone in my garden.

You need to defend your life man, fuck your plants. get a pistol grip pump action 12 gauge (mossberg 500) and if they try to come inside rack one round into the chamber. The sound of a shotgun loading strike fear into the hearts of shitheads. I would buy 00 buckshot for stopping power. You can buy beanbag rounds for any shotgun if you don't want to kill them but i would suggest real rounds incase they have guns too. Probably not a fed unless he was trying to snoop without a warrant but they usually like to build an unbeatable case.

Honestly. if you put anything on your property that could cause harm to the trespasser, you'll be sued. If you plan to shoot a round off, please shoot toward the ground and not the air. You don't know where that bullet will fall. If it were me I would hook up motion sensors to an alarm that would wake me. I don't know about the laws in Cali but here the person has to be inside your residence and be given 3 warnings you are going to shoot them. You also can't shoot them in the back if they are running. Around here, you also have to be ready to kill them because if they live they can sew you and probably win. Just my 2 cents.

I like the tent and radio idea.

"I like the tent and radio idea."

That might scare them away for a while, but eventually they will come back and try to catch you slippin. Chances are it was just a kid wondering through the woods and stumbled upon your garden, but now that who ever it was knows, they arent going to forget, and will return.

"Honestly. if you put anything on your property that could cause harm to the trespasser, you'll be sued."

Unfortunately, this is just another example of our rights being stripped away from us. Whats even sadder is the fact that the majority of americans allow it to happen.

Installing a parameter(fence), and signs around your property should be more than enough to justify defending your land. The person crossing the parameter(fence, with signs warning them) knows they are committing a crime and there for relinquishes their rights.

Some things are just common sense and worth taking a stand on, whether the law agrees or not.

"and dont put up any signs saying will be shot seen trespassin or anything of that nature... "they'll" get u for pre-meditated man slaughter.."

Bullshit.

If I was to see the perp on the other side of the fence, I would tell him he will be shot if he crosses. If he crosses, I will put one in em.
Doesnt get anymore pre-medited then that. But still within my rights as an american.

If your afraid of being sued, contact a lawyer and get advice.
Because when it comes down to it, you have three chioces. One, defend what is yours. Two, do nothing and risk having your crop stolen randomly. Or three, stop growing.

Im sorry if anyone is offended by my strong beliefs on civil rights. And again, I hope you get this resolved.

I wasn't offended, but I was just being realistic. The day we live in is a day where people are suing people constantly. You ever hear of the case where the guy tried to break into a liquor store? He fell through the roof and broke his legs, sued and won. If a fence and a sign are your Idea of a good warning and would hold up in court as such, I wonder what the owner of the liquor store thought when the guy came through his roof?

I agree though, call a lawyer and ask him for advice.

What are junkyard dogs for? One purpose, to attack trespassers.

Its all about knowing your rights and properly defending them.

Why are we able to arrest illegal aliens? Because they passed a property line(the border) knowing they committed a crime.
How many people do you think there are that dont know that crossing a property line means they are trespassing. Especially when signs are posted saying so.

The guy that was snooping through drunkenninjas garden definately knew he was trespassing. He ran when he was discovered!lol And when he comes back at night to steal the crop, he will know that he is committing a crime. How we allow the law to give any retribution to criminals like this is beyond me.

"If a fence and a sign are your Idea of a good warning and would hold up in court as such, I wonder what the owner of the liquor store thought when the guy came through his roof?"

Do I believe a jury full of Obama supporters would grant a criminal like this retribution? Yes. Ignorance is bliss.

Veering back to the subject, As I stated before, I would first contact a lawyer. Most likely the lawyer will tell you to catch the perp red handed(video, pictures, stolen property). He or she will also probably agree that posting signs indicating that beyond that point is trespassing, would be advisable and within the law.

Then(This is were I would have started) I would confront the perp. If I feel they can be reasoned with, I would attempt a conversation, offering to forget he or she was there as long as they promises to never return. If they ran, I would catch them, make a citizens arrest and turn them over to the authority. I would only resort to inhumane traps if the problem persisted. And I would only pull my gun if they came at me or pulled a weapon.

Firing an AK47 into the air would probably work but isnt safe and law enforcement will definitely arrest you.

call the police im sure they would be glad to help!
no the police will not help you. if you are in california and your neighbor complained or anyone that you are smoking pot they will most likely ignore you. its a low priority mission for them. anyways i would suggest to dig a hole around it like a few ft away from the plants, deep enough to hurt anyone trying to go near it. and install a motion sensor lights these would make em nervous...you need to think how they think. most likely if these are kids they would tell other friends and they going to steal ur plant at night.

Maybe a fence is in order. You can build one yourself for pretty cheap. Hell of a lot cheaper than paying legal fees when some potential thief gets jumped by you and your buddies. Google search booby traps. I just bought Razor wire to put along the top of my 6' chain link fence. I am a commercial grow dead in the center of a neighborhood. Fortunately I have no zoning restrictions but im sure when its ran I will start getting complaints. And yes I dont give 2 shits if it looks like a military compound to my neighbors!

Good advice. In CA, not only will you get sued, but first you will be prosecuted and thrown in jail. You can't install any kind of booby trap that would inflict serious bodily harm or death simply to protect private property - even in circumstances of a trespasser who intends to steal your property. Booby traps are indiscriminate and will injure/kill anyone regardless of intention. Like a 12 year old boy, the guy checking your meter or a fireman. Believe it or not, you owe a duty of reasonable care to anyone entering your property, including trespassers. Of course, you can always protect yourself with deadly force when certain criteria are met, none of which apply here.

Sounds like you're not going down that road anyway, good decision.

Honestly i dont think i have the heart to pull the trigger if I had to, Then i risk them kicking my ass & useing/taking my gum on me or from me. Sounds scary.
No offense dude, but you shouldn't even own a gun if you're are not prepared to use it. It will only get or your family seriously hurt. Also I'm pretty sure if you're growing pot and own a gun, it's against Federal law, especially a gun with a silencer. Wtf, why would you even need a silencer? Especially if you don't like confrontations because you have hardly any accuracy with a silencer unless you're really close to the guy. Anyways, good luck with your problem and know that they prolly will be back, so you should prepare yourself for that.

I guarantee you one thing, someone comes on my property un-invited, and/or refuses to leave when asked, I will do whatever it takes to defend me and mine. Against the law or not.

Just the sound of the pump action on a shotgun can put the fear of god into an unwanted visitor at night, just hope they don't have one too.
