Gun Laws - Change Is Coming

Ours is an example of how a case happens. I see the law one way, as a defense would, while the prosecution would argue the law from your position, and the jury would decide.
'Merica... a legal crapshoot.

Unfortunately in my town of Clare, they specifically ask about a card and will not issue a license for a handgun to anyone that has a card. They assume if you have the card, you are using the card. It is up to you to fight them in court.

You don't have to tell anyone you have an mj card. I already posted what the atf form says. it says if you unlawfully use or are addicted to marijuana check this box. If you have a mj card your not committing a crime, because you use it lawfully. They don't need to know you have a card. I guess the real question is are you addicted?
 
My advise is not to bring it up when buying a gun. I know a mmj patient thats buying a gun. got it on lay away, background check went through just fine, picking it up next week.

Interesting enough I have a patient in the office today in Muskegon that just defended his CPL as a 'non-using' but card holding patient. He came prepared with drug testing equipment to prove he wasn't using. The MMMA does not 'require' you to use marijuana if you have a card, but shields you from prosecution under state law. That is one reason the MMMA does not run afoul of federal supremacy.

Kind of caught them off guard...lol

There's a vid on youtube of a man in michigan defending his cpl and his card and he won as well (couldn't find it). Then I found this:


Best thing is not to tell anyone you have a card, your covered under hippa law. It's your personal medical info which no one has access to other then those You give the right to such as a doctor.

Innocent until proven guilty in a court of law. A most basic premise in our American court system. I can hear Alan Shore on his soapbox now.
 
LEO assumes you are using if you have a card, unfortunately it is up to you to prove you aren't, especially if you are applying for something rather than being charged with a crime.
 
Who cares what LEO thinks. I know that sounds like an immediate rebuttal is necessary, but it isn't. It doesnt matter what he thinks, it matters what the laws are. False arrest and deprivation of rights charges are available to you against such rogue officers. Just keep your mouth shut when dealing with them. It's not the cops job to know the law, and frankly, the courts dont expect them to. They have a double standard, expecting you to.

Hippa law does not cover a schedule 1 narcotic. Look it up I suggest google.
 
The MMJ law says that we are to be denied no right or privilege. That is pretty fucking clear if you ask me!!! We cannot be denied the right to drive a car or own a gun, no matter how bad the scumbag police want to take those rights away from us.
