Two Christian bakers who refused to bake a cake for a lesbian wedding have been ordered to pay $135,000 in damages by July 13 or else the state of Oregon could place a lien on their home.

Aaron and Melissa Klein, the owners of Sweet Cakes by Melissa, were punished by the state’s Bureau of Labor and Industry (BOLI) for unlawfully discriminating against a same-sex couple.

The Kleins, who are devout evangelical Christians, argued that baking the cake would be a violation of their religious beliefs.

The BOLI ruling ordered the mom-and-pop bakers to pay $135,000 to the lesbian couple. They were also slapped with a gag order that prohibits themfrom speaking publicly about their refusal to participate in or bake wedding cakes for same-sex unions.

And now - they have until July 13 to pay the damages or else face additional fines and a possible lien on their home.

“This is intimidation and bullying - that’s exactly what it is,” Klein told me in a telephone interview.“ They are trying to strong-arm me into handing over $135,000 to the two girls and if I win on appeal - they will never pay me back.”

A BOLI spokesman confirmed they sent a standard payment letter to the Kleins' attorney.

“The letter informs them that if we do not hear from them, we may turn the matter over to the Department of Revenue, which can place a lien on real property,” the spokesman told me.

BOLI said they would also be willing to accept either a full payment or payment arrangements.

“Of course, they can also ask for a stay of enforcement while they pursue their appeal,” the spokesman said.

But there’s a catch. The person who will determine whether or not to stay the order — is BOLI Commissioner Brad Avakian — a vocal supporter of the LGBTQIA movement.

“The judge, jury and executioner are all in one place,” said Anna Harmon, the Kleins' attorney. “He is intent on using his office to root out thought and speech with which he personally disagrees.”

Harmon, who is affiliated with Alliance Defending Freedom, said they were expecting the payment letter that came from BOLI.

“This letter, while it’s the normal procedure, continues to show the state is not backing down,” she told me. “They don’t think they did anything wrong here.”

Avakian’s strong arm tactics against the Christian bakers have outraged Christians across the nation.

“This guy would make Mussolini proud,” said Tony Perkins, president of the Family Research council. “This is a wannabe dictator.”

It certainly appears that Avakian and the state of Oregon have declared war on the Klein family.

“Not only do they want to drive them out of business, but they want to make them homeless,” Perkins told me.

The Kleins say they are filing a stay and do plan on appealing the state’s decision.

“Brad and his cohorts at BOLI have overstepped their constitutional rights in requiring me to cease and desist from my constitutional freedom,” Mr. Klein said. “I will fight them with every last breath I have.”

Mrs. Klein said she would not be intimidated by Avakian’s hard line tactics.

“We are so going to fight this, oh my gosh,” she said. “It’s making us stronger and emboldening us to stand up to this. Aaron and I are fighting for every American out there - for their freedom. We are not backing down at all.”

And while the viciousness of the attacks against the Kleins might be unsettling — Harmon said it really should serve as a source of inspiration.

“What a time to be an American,” she said. “It’s a hard time - our freedoms are challenged - but what a time to be able to stand and have courage and say, ‘I have a moment in time where I can be a voice for that.’”

And the Kleins are not ready to throw in the towel just yet.

“He definitely messed with the wrong Christians,” Mrs. Klein told me.

First of all, the only threat hanging over these people's head is a lien on their house. The lien is only collectible when they sell it. If they are so sure of winning the court case then there is no problem. Mussolini my ass.

But then again, rulings are not going their way are they? This could have all been avoided by selling a simple fucking cake to a paying customer. Instead, they chose to make a federal case out of it and now the pigeons are coming home to roost. If they lose, well there is a problem for them -- one they created by themselves. Do the crime, do the time. Isn't that what right wingers say to people busted with pot? So now they have to eat the same shit they dish out to others Suck it Aaron and Melissa gay basher.

Agreed. I live in Oregon and am always annoyed by the wait to get my car filled. I haven't had the same bad experience that you had, perhaps you exaggerated regarding "every", but they don't do anything that I couldn't do and sometimes they do it worse. Most don't even smear the bugs around on the windshield.

On the other hand, @spandy , perhaps your attitude had something to do with your service. The tone of your post suggests this.

As far as paying by the mile is concerned, it has nothing to do with the requirement for a service station attendant to fill the car. I'm not as paranoid about it as some but I admit that I'm uncomfortable with the proposal. Cars are more fuel efficient nowadays and use less fuel than before. The cost of road maintenance hasn't declined. Either we go with this new system or the fuel taxes will go up. Nobody is going to pay less. I don't see why we need the mileage meters.

Its not hard to keep the fuel off the paint., but you do have to give a fuck.

Same trip I was filling up some fuel canisters with a relative for the next mornings dune ride at about midnight. Kid comes out, sees 6 or 7 of our fuel jugs and we asked for them to get filled. His first words weren't hellow sirs, how are you, good evening, what can I do for you...nope. His first words were "Right now?" Place was empty other than a group inside paying the cashier. Apparently having to work while being paid imitated this kid. So I added to his misery and asked him to wash the windshield of the truck we pulled in, even though I knew he would do a shitty job, which he did, smeared bugs and all.

Maybe Oregon needs better training or free schooling on how to become a proper fuel dispensing engineer, and then teach them how to wash a window.

Or, perhaps, a class on giving a fuck? Every state needs that to be madaortory.

4 out of 4 stops. We were buzzing up and down the coast line in the 360 over the course of 10 days, family reunion and some other fun stuff. All young kids that just didn't give a fuck. 25 years in Oregon and I still don't like watching the fueling station attendant pump gas for me. Still, your story and your self righteous air about it is laughable. I never have the kind of experience you had. I think you brought an attitude and got served the way you deserved.

Yeah, I was totally having a blast that trip and because of it, every stop I got out in complete asshole mode, just ready to hate me a fuel pumper. So I totally deserved having someone not do their job and spilling fuel all over my car.

But what is the difference between spilling fuel on someone's car because of their supposed attitude, as opposed to spilling it because of any other fucking reason you can think of? Was that their job, to make that decision, or is their job to pump fuel without spilling for any reason?

You very reasonably set high standards that we should have met. I'm sorry that Oregon didn't live up to your expectations. I hope this doesn't mean that you will not grace our miserable little state again. The thought of never seeing you again is something that we simply cannot contemplate. I'll have a talk with the gas station attendants and get them to promise to try harder.

Not many of the stations clean windows or check your oil. It kinda has been a get out of the car and do it your self most of the time it seems anymore. If you ask them to do it some will and some are to busy to do it , so its not like the old days when all of them just did it and cared a little more. imo

And that would piss the banking system off over a cake.

The case is still traveling through the court system. I don't know why this case is different from the Hobby Lobby, which the defendants won.
They might win their right to deny service. We'll let the courts figure it out. I still find Mussolini reference and the puffed up rhetoric to be too much...

I let the Mussolini thing go in one ear and right out the other ear. And I think for a young couple that has a bakery that probably struggles to make a living can't pay that kind of money because they may not have much of a savings and 135K is just not the right punishment for a struggling self employed couple over a cake.

I looks to me that the state wants to destroy that couple to make a point, and so far it looks like it worked. I bet if they could do it all over again they would of baked the cake.

My take on this is the state did not want people to have a big protest over destroying this couple. You know that free speech that you were standing up for, it is not as free as you think.

Nitro, I don't want this couple destroyed financially either. Its my hope that if the couple loses the case, there will be a settlement that makes more sense. I'd prefer an agreement to follow the law and an apology to the offended couple. After all, the couple didn't suffer the same kind of financial harm that the business owners will. The punishment doesn't fit the crime.

The thing is, civil rights are for real and violating them is serious business. For that business to unlawfully deny the couple the same treatment that everybody else expects was not free speech, it was something else much less savory. Same goes with denying the flag burning protesters their rights. Civil rights are not something to trifle with. Otherwise, the law would put forth one level of protection but society in an unwritten rule can water it down. The couple has the right to their days in court to protest the law but they knowingly broke the law, and the penalty for doing so is pretty stiff. Brave they are, but maybe not so smart. We'll see.

The legal system is not a great tool to effect the kind of change that will bring the level of equality that homosexual couples are reasonably demanding but its the only option that the christian right allows. Wouldn't it be better if the right wing christian community could follow their own principle of treating others as they would be treated? But they don't do that. So for now the fight is taking place in the courts. At least its not taking place on the streets.

I don't know why the courts placed a gag order on the business owners. That seems extreme to me too. On the other hand, I'm not willing to jump to the conclusion regarding why. This all isn't passing the sniff test. Something smells rotten. I just don't know which side is reeking.

Don't bother. The turn over rate is so high that within 3 months they would have a new guy there anyway. Something about not letting people out of prison for work.

I shouldn't have set any standards at all with a gas pumper from Oregon. WTF was I thinking. To ask for fuel not to be spilled down the rear quarter. It was just too much to ask, and I'm an ass for even thinking it could be done.
