First thing you say is, "I'd like to have an attorney represent me.", Then you say nothing else. Ever. (Except to your attorney)

"I do not consent to searches" "Am I being detained" "I wish to speak with my attorney"
These are the things I have been instructed by my attorney to respectfully say in case I need them. If you are suspected of having a weapon you can and will be patted down however.

I kept telling him I didn't want him to search me. I actually got him to verbally agree that he didn't have a reasonable reason to search me.

You let him search you anyway?
LOL Ive repeatedly said "I choose to invoke my 4th amendment to be free from unreasonable searches of myself and my belongings, I choose to invoke my 5th amendment right to remain silent, do not ask me any questions, I choose to invoke my 6th amendment right to have an attorney of my choice present immediately". Not only did I wind up in handcuffs getting searched they continued to hammer me with questions even though I repeatedly told them I want an attorney. Might as well pull out a copy of the constitution and piss on it infront of me. As much as it sucks not all cops go by the books. As far as the OP goes, if the cop told you he didn't have any reason to search you, I would have said "I wish to be free to go and cease this contact immediately" that way it could be argued in court by your attorney that there was no probable cause and you where held against your will.

I don't know about Minnesota but if you're not on probation (in CA) they can not search you. Second 1.2 g of green is nothing. At least in Cali. Shit cops would rather bust me for illegal fireworks than greenery. Plus I'm a card holder. But there is no intent to sell just smoke. Your doing 25 to life pal

What can you say. Say you have agoraphobia or something.

What's the charge though ?

None of those are good reasons to voluntarily give up any of your rights.

Not saying give up your rights at all. Im just saying sometimes police just do not care period and will search you regardless if you demonstrate your rights or not and im guessing there are some cops that wouldn't hesitate to shoot you or taze you for the smallest of reasons. All im saying is if you encounter the police be smart, say nothing that would incriminate you, be polite yet firm, demonstrate you know your rights and above all hope for the best but be prepared for the worst.

I say eat a bunch of laxatives and when it's your turn shit as much as you can right in your pants until it runs down your leg and all on the floor, that will teach them and they can't do anything about it, just say, sorry, i don't feel well

A pat down is 100 percent legal for a police officer to preform on you.

It is however not legal for him to empty your pockets.

He can legally circumvent this by saying the pipe you had felt like a knife or some kind of weapon.

What exactly were the charges? Did they get you with the paraphernalia?

Let me see if I can remember this as it was going on 40 years ago.
You'll go to court and the judge will say to you.
2 years prison time or go into the service.
Most likely you take the service but...
you end up doing it in a place called Vietnam
a place were 53K soldiers will die.
But that was 40 years ago so it's going to be worse...
