I don't think that's what the ruling said. What I understood is that the appeals court ruling imposing a 6-month mandatory bond hearing or the person automatically gets released to his own recognizance or whatever they call it in immigration, was not within the scope of what an appeals court can do. That action imposing a hearing deadline should be left up to the legislative branch of government if the executive agency can't do it itself.
I could be mistaken bc I am not a lawyer, but it's not so much a cheer for indefinite detention than a slap on the wrist to the appeals courts....
I don't like that the guy in this particular case sat in jail for 3 years either over some bullshit charge of drugs and joyriding (I don't even know why that is a crime now). That sucks and should be fixed.
if only Congress had the balls to deal with real issues they could fix this, pass a law that expedites the immigration court system, fully fund and staff with a competent and streamlined process.....but yeah Make America Great Again and all that....
