i agree..now they are the experts....how did they get that title? how did they get experience or expertise? i few months ago, Rona said there was no studies and none done by HC so how is it possible that in a very short time, they became experts?

I don't know how it possibly took this long for law enforcement and governments to wake up and smell the weed.

Now that they have it's all about money in their pockets. I'm sure there will be plant limits but I'm expecting them to be no greater than six per person and that may even be a reach.

Hopefully the medical system is exempt from certain aspects of legalization as far as plant counts without having to go to court.

Unless they say fuck it thats too complicated, and dismantle the medical system and move everyone over to a Rec system. Wouldn't put it past them the lazy fucks. Thanks for the higher taxes on my meds.....................

I can't see that happening. I will be shocked if they banned home growing for rec, and MMJ patients have a need rather than a want, so I think we'll be fine. Even in Washington State where rec home grows are not allowed, medical patients can grow. Colorado has a 6 plant limit for rec and patients are exempt. I think giving the LP's first crack at the rec market will be enough to take some of the medical side away from them without too much flak. Legal or not, I'm not shutting up until my right to grow is guaranteed.

Legalized for rec will mean legal to grow. It would only be illegal to sell (income tax fraud). Just like anything else that is for sale. What you be charged with illegal production of an legal good. That would get laughed out of court.

It already has. Mmar is dead. The judge is ruling of the mmrp is constitutionial. Its upto hc to determine how the program moves forward after the decision. With any luck the ruling will be in our favour and it will be legal to grow. But ultimately hc has the final say. Personally i think that hc will drag its feet until the law is changed for rec so that way they can wash their hands of it. A premature program will not fly because big pharma and insurance dont what to give a din number and loose on the billions from the bs pills they want to stuff down your throats. Also lps will be pushing for a rec market because i think that was the plan along. Just like everyone else they cant see anything but dollars. Sorry about the rant but nobody cares about the patients.

what's the injunction if the MMAR is already dead? i am wondering about the patients that are not left out that are legal to grow. will they just say "too bad so sad"?
there will be lawsuits if that's the case. i hope Phelan isn't that short sighted...but he may as well be with the time he's taking to make up his mind..or at least release his decision.
maybe Phelan is talking to HC before releasing the decision

I don't think he is allowed to talk to HC about his decision. He is supposed to weigh the evidence presented in court.
i agree completely...he's not supposed to but if he says he's going to rule in our favour, maybe he's giving them a heads up and they asked for some time to get a program in place.
this is only speculation. i have nothing to back it up....one reason i think about as to what the hold up is. it's nuts having to wait like this.
i feel like a dog waiting by the window everyday...."will it be today?? will it be today??"

No, the courts have the 'final' say. If it was up to HC there would be no medical program whatsoever. If Phelan rules in our favour, we will likely see the 'of no force and effect, suspend declaration of invalidity to allow govt to change things' pattern.

Also there will be no 'grandfathering' or 'only MMAR can grow' situation. Whatever Phelan arrives at will apply to all 'medically approved' patients. For MMAR exclusive 'right to grow', each MMAR person would need to have a constitutional exemption from the CDSA, and that is something that is almost never given even on a temporary basis (Mernagh and Parker are the only to ever get this to the best of my knowledge).

but HC can do the bare minimum like they have.
look at the most recent-Smith case for edibles-we can possess in any form...we just can't make it.
we needed reasonable access etc-Dg's could then grow for 2 people. addresses were to be able to have multiple licenses and HC made it so only 4 per address...etc. that's how they will have the final say
