There is a grow house in my GF's Rental

just getting some input..

A woman I am dating has a rental home in Cali. She told me that the tenant has been there for 5+ years and she just found out he turned it into a grow house.. he says he is permitted and will pay more rent.

I'm wondering what are her potential risks?
Up until this point she had no idea. If she raises his rent then she blows her plausible deniability.

Could the home be seized the cops or feds?
Can he be evicted? He is using the home for an unintended and unauthorized use.

I would guess that there is likely damage to the interior, but she doesn't seem to care much.

I would guess that there is increased risk of fire or litigation so at a minimum she should carry more insurance.

Her plan is just to raise his rent and let it proceed.

Sounds like she's made her mind up already. If it were my property I would travel to the grow site to make sure he is in complete compliance. I would also, most certainly, as a homeowner be very concerned with any interior or exterior damage there may be. Home repairs can be insanely expensive!
If the grower runs a tight ship and is legal, clean and competent, I would let him go about his business with an increased rent amount.
You also will not have to worry about a federal or local enforcement agency seizing the property because they must give landlords written notice of future action. They give you a chance to evict the tenant. If you refuse to do so they may or may not seize the property.

A grow that is not done properly and ventilated properly can destroy a house with mould, over taxing the electrical, I would say go buy your own house. Here if your caught growing, they will record it on the deed and the owner is responsible for remediation.

has the tenant got an online id at what site..? ( incasehedoesarunnerlater)

the catch here is ur babe raising the rent cause he's growing at the abode

or is it just up for re-newl, in which case she may boot him out, just for the weed hassle

see as he may be running a business from a residential address

many holes to this lease.. maybe see a lawyer?

it could be bad and good but most of the time they trash the place or ruin things in the process I would ask to look seound make sure nothing looks unsafe and damaged then I would determine from there what you want to do medical isn't going away unless he's running 1000 plants I highly doubt there is much risk there but good luck and make sure you get more money since there is a risk to damaging your house

The one thing I would be cautious of, is the half ass electrical work some of these people do. They are always trying to do it on the cheap, and will overload the circuits, daisy chain shit, etc......

They also seem to just think cutting holes into random walls and shit to vent is okay too.

The only thing about it is the Feds could tie the landowner to it if they want. State laws allow it as long as everything is legal and within regulation/laws so you're good as far as that goes. But Feds don't give a shot about state laws.

Maybe, but on the other hand the Feds aren't interested in compliant grows in suburban homes. The fool would have to be doing a lot more than growing some weed to get their interest, like gun running or interstate meth distribution.

Right there would be one of the biggest concerns. Fire is always a danger and it would be prudent to find out just what would happen if it should occur. If a claim could be denied somehow because of the operation then yes its a big problem.

Yes and no. If his neighbors decide to call the cops because the smell bothers them, he will get raided. All it takes is have a light or smell leak and one neighbor who doesn't like what your doing to call the cops. And as he isn't the homeowner, they probably wouldn't think twice about just taking the house and forcing your lady to come out to deal with it, fines, and court. And afterwards she'll get the house back if everything actually is in compliance.

Also, With the new laws passed, every grower larger than 100sq ft has to register now?

I would say you're probably good, but just pointing out that if the Feds ever wanted to, compliance doesn't mean shit.

I would have the house inspected for damage and get them out. If the feds just so happen to get involved with this individual you could lose the house.

lol @ everyone saying house is probably a mess.. you guys must have some fucked up grows. i keep my area spotless. my opinion is.. if the guy been there 5 years, id let him keep doing his thing. if he offered more rent, take it. if hes a legal grower i dont see the harm. id just make a new lease saying any problems caused by the grow has to come out of his pocket and maybe get an extra security deposit.

yeah, make sure she has some fire insurance for sure
