The U.S. Vape Mail Ban ..Vapers Beware!

I've been been making my own juices and vaping nicotine for the last four+ years. This morning I got an email from one of the suppliers that I get PG/VG mix from only to find out that after March 26, 2021 these online suppliers will no longer be able to send vape related products (for both nicotine and cannabis) via UPS, FedEX and USPS. This is all most likely because of Big Tobacco's pull and nothing to do with supposed age restriction violations. This is going to be a huge blow for both mom and pop vape shops and the home consumer. I was a little surprised to have received the news so late in the game but then again I don't keep my ears to the ground in the world of vaping. Anyway, in case there's anyone else out there that depends on the above named carriers to bring you your vape supplies you might want to consider stocking up ASAP. Here's an article that can give you more detail than I just have. https://vapebeat.com/health/advocacy-the-united-states-vape-mail-ban

The USPS vape ban happened last summer, which is why my fav e-juice company, Black Note, switched to Fed Ex. Shipping is still free. Can you post a link from a credible source regarding Fed Ex and UPS not being able to deliver these products? I've heard nothing from my company, which sends notices frequently. I think they would be the ones warning about this if it was legitimate info, as they more than anyone would encourage stocking up. Thanks.

Here's a thread on one of the more popular vaping forums discussing it. https://www.e-cigarette-forum.com/threads/us-shipping-cutoff-dates-usps-fedex-ups.958385/

A simple search for 'u.s. vape mail ban' should give you all the evidence that you'll need.

This bill bans all shipments of vaping products by the US Postal Service, and forces all other postal delivery services (such as UPS, FedEx, or DHL) to check IDs and obtain signatures of adults at points of delivery.

It isn't stopping home delivery just requiring an adult signature.

That's incorrect.

SEC. 3. NONMAILABILITY OF ELECTRONIC NICOTINE DELIVERY SYSTEMS.

(a) Regulations.—Not later than 120 days after the date of enactment of this Act, the United States Postal Service shall promulgate regulations to clarify the applicability of the prohibition on mailing of cigarettes under section 1716E of title 18, United States Code, to electronic nicotine delivery systems, in accordance with the amendment to the definition of “cigarette” made by section 2.

(b) Effective Date.—The prohibition on mailing of cigarettes under section 1716E of title 18, United States Code, shall apply to electronic nicotine delivery systems on and after the date on which the United States Postal Service promulgates regulations under subsection (a) of this section.

.

(1)In general.—
All cigarettes and smokeless tobacco (as those terms are defined in section 1 of the Act of October 19, 1949, commonly referred to as the Jenkins Act) are nonmailable and shall not be deposited in or carried through the mails. The United States Postal Service shall not accept for delivery or transmit through the mails any package that it knows or has reasonable cause to believe contains any cigarettes or smokeless tobacco made nonmailable by this paragraph.

Could you please show me an actual controlling, primary source that prohibits private delivery companies with adult signature requirement from delivering these items? Because I can't find the law. Thank you.

I never said that private delivery companies couldn't deliver vape products. Bottom line is that it's going to become very difficult for those who who mail order vape products. If you want to maintain a pissing match due to my creating a PSA (for people that obviously aren't you) then you're on your own. On another note, thanks for reminding me why you've been on my ignore list for quite some time.

Following congressional passage of the “vape mail” ban that will end U.S. Postal Service shipping of vaping products to consumers, UPS has joined Fedex in announcing it too will end shipping of vapes. The ban covers shipping to both consumers and businesses.

Effective April 5, 2021, UPS will not transport vaping products to, from, or within the United States due to the increased complexity to ship those products,” a company spokesperson told Vaping360 by email. The policy, which will soon leave no major shipping service willing to deliver vaping products to homes, has left online vaping retailers scrambling to find a solution.

The announcement followed days of uncertainty, with some vaping businesses being told that their accounts would be closed, and others being reassured that the company’s tobacco and vapor product policy would not change. (The UPS website has still not amended the policy.)
Fedex had already confirmed that it will end vapor product shipping as of March 1. DHL, the other major shipping service, previously banned domestic retail shipments of e-cigarettes and all nicotine-containing products.

Thank you for the heads up on this issue. I just received this email reply from Black Note, my fav e-juice company -

Please rest assured that the delivery methods and carriers may change, but we will continue to ship as usual, and you will continue to receive your orders. On a side note, the vape mail ban proposed rule has opened up for a 30-day comment period which started on February 19 and will become final and effective on April 26, 2021. There is still a chance to STOP the Ban on shipments of vapor products to consumers. In the event the Ban becomes final and effective. Black Note will be choosing from one of the following B2C carriers unless FedEx or USPS changes their mind.
Direct to Consumers options

  • Vanlo (XParcel)
  • GLS
  • OnTrac
  • Echo
  • AxleHire
Also, we are currently working diligently, setting up systems that are fully compliant with every provision of The Pact Act. We will be fully compliant soon.
Hope this helps,
Thank you
