Wade Barnett, of North Carolina, was sentenced to time served and ordered returned to the U.S. after he pleaded guilty in an Ontario Court of Justice in St. Catharines to a charge of possession of marijuana.

Court heard Canada Border Services Agency officers questioned Barnett when he pulled up to a primary inspection lane at the Peace Bridge on Jan. 24.

When asked if he had any weapons, the 47-year-old admitted to having a loaded 9.mm semi-automatic handgun and a .38-calibre revolver in his truck.

When border agents searched the vehicle they noticed a strong odour of marijuana to which the driver admitted he was recently in Colorado.

In early 2014, Colorado became the first U.S. state to allow the retail sales of recreational marijuana.

Barnett had more than 500 grams of loose marijuana as well as a variety of items containing tetrahydrocannabinol (THC, the active ingredient in marijuana) in his truck.

Among the stash were 53 pot-infused chocolate bars, four soft drinks with THC and 135 pieces of THC candy.

"They were all purchased legally in Colorado but he shouldn't have been traveling with them outside of the state," assistant Crown attorney Wally Essert told Judge Terry Vyse.

Court heard Barnett has no criminal record and owns and operators a campground in North Carolina.

During the off-season, he enjoys traveling across the U.S. and January's trek included a trip to Niagara Falls.

Unbeknownst to him, however, there's a Niagara Falls, Ont. and a Niagara Falls, N.Y.

"He was under the impression Niagara Falls lay entirely in the U.S," said defence lawyer John Bothwell.
