A law officer making an arrest must read a statement based on this rule, which is usually called "reading your rights" or "Miranda rights". If the police fail to advise you of your rights at the time of your arrest, any statements you made before or after the arrest would be and will be excluded if you were put on trial.

They are not required to be read if they caught you in the act and need not words. But if you are being "detained" and taken to the police station, you need to know your rights.

1022, read what FDD and myself have posted... If they AREN'T using what YOU say IN COURT... Miranda Rights aren't necessary.

I'm not gonna repeat that phrase again because quite frankly, you can believe what you want to believe and when it comes time to go to court and you expect to use that as a defense, you'll be the one saying, "Oh fuck... Socata and the others WERE right."

Fair enough, I've been there and done tha.t Sometimes it's better to roll with the punches, no matter how low they are. I hope it works out for you, but if I were you and they offer, I'd take a couple classes and not have it on my record rather than waste my time and money for the "principle" of things.

So if i get this case dropped what does that mean for my license i got suspended for a year? Will i get it back or since i had refused to give him urine sample its still taken away?

Mmmm... that's an iffy one that I would definitely talk to a lawyer about as each state is different on the whole "Refused to Give Blood/Urine Sample" thing when it comes to suspending your license.

Dismissed Charges and the DMV

Suppose your charges get dismissed by the court or the D.A. decides not to file your case. You may be entitled to have a subsequent DMV hearing to try to get your suspension/revocation lifted. However, even with this favorable court result, there is no guarantee that the DMV will follow suit.
