should marijuana still be tested for in decriminalized states?

or what about medical patents trying to find a job? should they be denied because they take oxicodone (fail for opiates) or medical marijuana (obvious)?

i have friends on probation who get drug tested all the time and spend tons of loot on drinks just because they toke a little ganj. its not even illegal anymore! we shouldnt be scrutinized because we partake in the healing of the nation

If you have a prescription for what they are testing for you just have to show proof of prescription.
Also just cause something is decriminalized doesn't mean it isn't illegal.
It simply means no criminal record will be kept and you receive a fine, kind of like a traffic violation.

It's not considered a "real prescription" though. So even if you have your MMJ card, it doesn't protect you from testing positive for THC like an ADD Medicine prescription would if you tested positive for amphetamines.

its bullsh!t; in medical states you can cultivate your own, you can walk to the corner dispensary and buy an ounce, you can even get cops to return medicine that has been confiscated, but you cant test positive for canabanoids?!

Kaleo, i agree with you 100%. Marijuana shouldn't be tested for in decriminalized states. I can even think of incidents where they shouldn't be able to test you for it in states where it isn't decrminalized. A good example is (actually just happen to a friend last week), when it comes to drug testing for a DUI. I had a friend that got pulled over because they were going 8 mph over the speed limit while passing a car going down hill on the highway. The cop asked her to get out of the car because he said he suspected she was drunk. She wasn't drunk and hadn't smoked since earlier that day, but had a small amount of bud with her in her purse with a hitter box. She passed a field sobriety test but then he arrested her for the marijuana he found when he searched her car. Once he got her to the jail, he had her drug tested. She failed the drug test because she had thc in her system and was given a DUI for it even though she wasn't actually high while she was driving. The situation got worse after that. The cop kept telling her how stupid she was and had her crying while they kept asking her where she got the marijuana, if she had kids they could take them, etc. She told them that she wasn't going to speak to them without a lawyer several times while they kept asking her questions. They also kept going back to her cell repeatedly to ask her. She told them she had the right to remain silent and the officer told her that he hadn't read her miranda rights and she had no rights in jail. They kept her overnight and they tried to impound her vehicle and say that she bought it with drug money! (she had a hitter box). It's finals time right now for college students and they wouldn't even let her get her backpack with all her notes and books from her car when she got out of jail so that she could study and take her final exams. Sorry for rambling on with this story, but IMO it is all an abuse of power, beginning with the drug test and charging her with a DUI with something they can't prove you were on at the time you got pulled over. Anyways, i think drug testing can have it's advantages here and there, but the bullshit caused by them far outweighs the advantages they do have. In the case of a job, i think it's just plain stupid when it comes to thc. There are plenty of successful people out there that smoke marijuana on a daily basis. Drug tests are too often used to define a worker when the quality of a persons work comes down to each persons individual character traits that they have whether they use drugs or not. I think that government is afraid for people to know that someone who uses drugs, especially marijuana, can be just as or more successful than someone who doesn't use. I'm beginning to see it as a form of descrimination and envy. I don't know how many times i have been called a stoner in a derogatory context by people that don't smoke, yet i have been more educated and successful than 99% of those people. Sorry i wrote so much, but this is a subject that i'm fairly passionate about.

your supposed to have your rights read to you the minute your arrested and you still have the right to plead the 5th and not incriminate yourself or others

That's what i told her. As soon as the handcuffs click you should be hearing someone reading you your miranda rights PERIOD, no exceptions. Being her dealer and just the overall nice guy i am, i went ahead and sent a 1000 dollars with a buddy to bail her out and another 2000 retainer for one of the better dui/drug attorneys in the county she was in. She was charged with DUI, possesion, speeding, and paraphanalia. The goal as of right now is to pay the speeding ticket, get the dui and paraphanalia dropped, and get probation for the possesion charge.

Companies will still test regardless if u have a card or not.
a lot of them get federal grant money/help and must obey federal law.
u can be a US Marine with a dr note and still be prosecuted for failing a piss test.
u can also be a truck driver with a federally issued drivers license and will lose your job if u pop.
lots of jobs test after accidents and having a card wont help u if something happened. this is not because of the government but because of insurance companies
