so months ago a good friend of mine is being charged by a federal grand jury with conspiracy to possess and and distribute a very large amount of marijuana. it is only a conspiracy charge and im not sure what evidence they have against him. hes in michigan, i know the sentencing criteria and such from http://norml.org/index.cfm?wtm_view=&Group_ID=4544 i also know they never give you the maximum sentance. anyone have any experience here?

thanks, any feedback appreciated

If your friend was charged by a Federal Grand Jury it will fall under Federal law, and not state law.
I hope there is no manditory minimum sentence for the charge,

michigan has non manditory minimums for pot, however he is being charged with a federal grand jury and it did involve the dea and atf. he has no criminal history though. thanks for the response. any other info is greatly appreciated. i dunno, would leaving the country be a better choice before sentencing? im not sure what the statue of limitations are.

for most statue of limitations, it is 5 years for Federal Drug conspiracy charges. However, the prosecution can extend the limitations until the act of conspiracy has ended. Meaning until they can't find anyone else in the case. Although, we do not know all of the info presented, your drug conspiracy charges in federal court is a pretty dam serious one. A Medical MMJ Defense is not usually allow in federal court. Your buddy is probably charged under Title 21, United States Code section 846
Your best option is putting together a legal denfense team to protect the peps involved, which one would assume that is already done!
