Saskatchewan: Cannabis Returned Unusable, Says Accused In Medical Marijuana Raid

A former employee of a medical marijuana dispensary in Saskatoon is blaming police for the loss of what he says is more than $1,000 worth of cannabis.

Lane Britnell, who was one of four people charged after police raided the Saskatchewan Compassion Club and his home in October, says cannabis oil and dried cannabis taken during the raid but recently returned to him are now unusable.

The oil is stuck to a plastic evidence bag, and several different strains of the dried bud, which the 24-year-old claims were separated in labelled jars, are now mixed together.

“I use different strains for different symptoms. So that would be the equivalent of just taking someone’s pill bottles and dumping them all into one jar and giving them back. So that was destroyed. I couldn’t use it,” said Britnell, who lives with Crohn’s disease.

Two used gloves were also jammed inside a jar some of the product was returned in.

The drugs would cost more than $1,000 from a licensed producer, he said.

“I hope, moving forward, police officers are educated about medical cannabis and don't treat this like Hells Angels drug busts,” he said. “This isn't crystal meth. They're treating these cases like any other drug case, and these officers need to know people need this to live.”

Britnell, a former University of Saskatchewan Huskies’ pole vaulter, said cannabis is the only treatment he’s found that helps with Crohn’s, a chronic inflammatory disease that affects the intestines.

His doctor advised he use cannabis oil after other treatments failed.

“I failed every drug possible,” he said. “I was about to do clinical trials. We were completely desperate. I never used cannabis until I had failed a long list of hard medications.”

The treatments have since allowed him to pick up his active lifestyle, he said. He’s a fitness instructor at a downtown Saskatoon gym.

“If I vaporize cannabis before a workout, I don’t get sick. Whereas, typically, when the Crohn’s is active, I’ll break into a cold sweat just from jogging for a couple minutes. So it’s really allowed me to get back to my old life of fitness that I didn’t think I was going to be able to ever enjoy again.”

Six charges against Britnell — all of which were related to marijuana derivatives like cannabis oil — were dropped in January.

He’s still facing charges of trafficking and possession as well as possessing the proceeds of crime.
Saskatoon police would not comment on the case, stating the matter is before the courts.

I think because of the Owen Smith supreme court trial....not against the law to make and possess concentrates anymore.

When are you open for business?
there is a law for us against making concentrates..we can possess them...i guess you're supposed to pray really hard and they will magically appear
that's Government thinking at it's finest

I'm pretty sure we can make them too

"Thursday, August 14th, BC’s highest court confirmed the rights of patients Authorized to Possess Marihuana under Health Canada’s regulations to make with it whatever they see fit. The decision is binding on trial level courts across Canada, persuasive on provincial appellate courts. If there is an appeal launched by either side, the issue could reach the highest court in the country, the Supreme Court of Canada."

patients are not allowed to use solvents per HC not what the judge said
marijuana
it does become illegal when you put butane or else into it, but they said as long as there is plant martial in it like a dot then it's not considered synthetic thats what they ruled here but the labs around here got busted for illegally saying there was no plant material so they could charge you with it

i can't find it right now as I'm at work. it was the dumbest thing about not being able to use solvents. the LP's gt a sec 56 so they can produce with solvents. you can possess it in any form.
i'm not making this up. it came shortly after the Smith decision and I agree it is SO stupid and makes NO sense.
if you can show me i am wrong, please do. i still make my own oil as well and have no plans to stop.

Yep, the S.56 to LP's was yet another fuck you to patients by the ex-minister of outrage.

The Allard legal team has said that the ruling means you can produce. If you're busted, the case isn't going to go anywhere (possibly pending safety issues resolved in Allard).

So basically ignore HC. R v Smith says arbitrary limits don't work.

if they stepped back and looked at their decision- you can possess it but can't make it" are they laughing at how they screwed us again?? i am sure they are not that stupid-well i hope-that they can't see how impossible they tried to make it.
is someone in a room saying "how can we screw with them on this?" and has a team working on this kind of thing? doing the bare minimum??
i still say that if they needed it the laws would be different. if Rona or someone in her family used cannabis to cure their cancer, she wouldn't be toting "it's not medicine" she'd be overjoyed at what the oil or product did....but until then, nada
