i was wondering whats the laws like when in comes to patient to patient sales or transfer of goods for medical marijuana in cali? is it allowed or whats the punishment?

what do you think is the best way to go about retailing? anything better than craigslist?

I've learned with really good meds that it sells itself, and with the average stuff you will have to do some leg work to move it.

Taking it to the clubs is best. Peddling on craigslist or budtrader to strangers leads to getting jacked. Even if you find someone solid to buy it..the price will have to be way lower than you would get at a club,because they would be assuming the reason that you are not selling it at a club is because it wasnt good enough.

You are legal to sell to another patient if you verify their recommendation and charge only what covers your expenses. You are better of selling to a dispensary but realize that some dispensaries may try to rip you off too. There's a very helpful thread that's stickied about rip-off dispensaries. Best of all just open your own dispensary!

look before u fuck up like i did, fuck craigslist, fuck bud trader....piggies postin tryin to snag ya up....patient to patient is still illiegal...well let me put it to ya like this, if it aint someone u dont know then dont fuck with them....i was told when i moved here it was legal well guess what its NOT...facin some bullshit charges dont wanna get into details.....but it was off of craigslist.....n i asked the same thing u would ask 215/ca id but na it was a sting operation, keep it underground or keep it to yourself...oh n another thing....transporting...still illiegal to carry over an ounce....if anybody knows anymore about that law share.but yeah fuck the internet figure it out in a SAFE way....

Whoa there! Wait a minute. I did NOT say anything about Craigslist, Bud Trader, etc.... I said in CA the law states you may legally sell overage to another patient for cost. I did NOT say you would never have to make an argument in court.

Cannabis is currently Schedule 1 and as such you have to be extremely careful. I am very sorry you got into trouble but if you were following all the rules then you need to lawyer up and make the argument and don't let them railroad you **IF** you were following all the rules & technicalities. Anyway I am extremely sorry you are in trouble. But that doesn't make medical marijuana sales between patients in CA illegal.

That may be a grey area... i read the whole attorney general guidelines and I don't think it ever said you HAD to be in the same collective, but it also said those were the intended method for organization distribution. They also expect the collective to collect the sales tax. So they can at least make an argument in court for two things on a craigslist sale... no sales tax collected and overcharging (profit).

I'm not sure why cannabis is the only product sold in this country that has to be done non-profit -- the pharmaceutical industry certainly does not operate on a non-profit basis so WTF!!!

No there was nothing in Prop. 215 about needing to belong to a collective. Collectives came along with 420 by the legislature. The legislature does not have the power to revise Prop. 215 because it was done by direct legislation of the people. They can add to it, but they can not be more restrictive. Legislation by the people is a very powerful tool.

It's like the 6/12 plant numbers that are out there. There is nothing in 215 that quantifies how much medical marijuana someone may have. So someone had to go to court to make legal precedent to halt the specious plant counting.

So it depends on how risk averse you are. Going by rules with precedent keeps you from making the argument. When you fly without precedent you need to have the wherewithal to make the argument or take the consequences.

This is huge! No matter what you do you MUST pay your taxes. Taxes and postal laws are HUGE levers for the Feds. So it's very important to make sure you don't run afoul of those snares.
