Paranoia has me thinking

Hey guys love the site lots of helpful info, but I wanted to run my situation by you guys to see if its paranoia or normal. I use to have a little closet grow for a few years then had to stop, I recently had the urge to start something up again, as I just bought a new house, which is part of the problem, I dont want to loose my new house its little but nice. lol Can they take it? I live in TN. I was going to do about 12 clones with 6 plants flowering.

The other 2 problems is I just went and purchased a new 400 from my hydro store, which is 2 hrs away (I dont think they would follow me back home so no worries there), but my Mother has decieded to do her thing with legit flowers and keeping plants alive during the winter, so I purchased a 600 watter for her off ebay HTG Supply (notice a few guys on here purchase from there)

So i guess im worried there going to trace something back to me I didn't use any of my items credit card, name, address, etc just my Moms, but my Mom is own the loan with me for my house, Didn't know if the pigs would try that hard or not, also what would happen to my Mom if I were caught since she is on the loan.

So am I Paranoid or what

Rule number one... DON'T TELL ANYONE.

Follow that rule and you should be alright. If you haven't made any purchases via your credit cards, you should be more alright. Hydro Store is two hours away and you paid with cash, even better.

The bad news is... If properly motivated, yes, they can take your house. But, they would have to catch you first. And if what's listed above matches what you've done so far, you should be fine.

400w HPS isn't enough to draw any attention due to power consumption, especially if it's a larger house. I wouldn't put it in the attic or in a room with an exterior wall however.

And about the Hydro Store, if 'they' were going to follow anyone home, it wouldn't be a guy that purchased one 400w light set up. 10 of those in one purchase, you might have a problem. And that's only if the place is being watched. If something was going to happen due to that purchase, it would have been you being pulled over for some bullshit lane change violation a few blocks down the road followed by a bunch of questions and perhaps they run the dog around your car.

As for your Mom's stuff purchased on her credit card... They only thing they would be able to find out about that without a full look in to her financial background was billing address.

As for the trouble she would get in to if you got busted... None, as long as she doesn't know she has plausible deniability. In fact, if she's on the loan with you and doesn't live there... That might work in your favor if they try to take your house. That's a financial punishment and they can't punish her for what you've done. Don't get me wrong, they'll try. But, a lawyer can most likely put a stop to that.

For peace of mind, you might want to invest a few hundred bucks in visiting with a lawyer and as him these questions. Attorney-Client privilege will keep what you tell him between you and him!

One other note... For a good lawyer... Check NORML they should have a list of 420 friendly legal counsel in your area or at least as close as that hydro shop. :) That might make that visit feel a little less awkward.

Yea thats one of the things that I'm doing different this time, last time I had 3 roommates so it was hard, but now its just me, the only person that will know ismy bud who is boosting me with some clones.

Yea I drove down in my moms car, didn't smoke, in and out, paid cash, went speed limit on the back. Like I said I'm paranoid

Then my cabinet and veg room will be in the middle of basement which is cement block, and only one window that is covered up.

Yea thats a good idea about the lawyer wouldn't hurt, Thats the very last thing that I would want to do is hurt my Mom in any shape or form cause thats how I am able to have my own house. Another question I have is do they take ur car too?

I sometimes ponder if my Mom is questioning how I know a good bit about indoor growing, but then I realize she has know clue. lol

I wonder if pigs would go check out my Moms stuff to see if she is doing something illegal, then that way I might get some sort of hint. just a thought

Another thing is that all my neighbors are 60 and up, and I talk to them on a weekly bases.

a friend of mines sister and her boyfriend got caught growing like a $100 grand worth of weed at there house and they still have the house..sooo...

just know your rights first too, unless they got a warrant they cant come in, no questions asked even if they lie and say they can, dont fall for it...or for some paper saying "consent to search" and dont sign it if someone ever handed you one, I had a friend do that. that is expressing consent when you sign their trick paper. If they have a real warrant the first time youll know is when you hear the door crush open and them Yell, POLICE SEARCH WARRANT...

i think yur just a little noid man, we all go thru that.

as far as yur house if its yur first offense or youve at least not been in a lot of BAD trouble theyd be hard pressed to do so...unless there is some weird law saying that but it would take a lot to do time on yur first offense which im assuming it would be if something happened, if it wouldnt be yur first offense then check the MMS laws in your state and see if it say you lose your house...i doubt it highly. Any first year lawyer could legally gift it to a frien or family member, if you got kids will it to them now if your worried.

Thanks guys for the moral support I figured I was over reacting, I was again thinking that unless they have some hard evidence then I dont think they could get a warrent just because I bought a grow light... It seems to me they would need a neighor or a rat to get a warrant and those are the things that I am most paranoid about.

What if you owe more than your home is worth? You think they will take it and won't the authorities now have to assume the payments on your property that you hadn't finished paying off?

Try doing a Google search for "Cultivation, Production, Marijuana, Arrest, (your county or city), Drug Bust, Grow, Grow Operation"

That should pull up some stuff locally for ya. Change the words around a bit by dropping a few and it'll pull up different stuff. Most of it will be TV, Radio and Newspaper websites which is what you are looking for.

Your local county, city and law enforcement websites will have some 'bragging' stories about busts too. But, just the big ones where they were able to screw someone to the wall real good.

yea ur way parronoid not a bad thing in this trade but honety especially in the basement u will be fine i bought all of my grow supplys from htg with a cc to my house that i will grow in it doesnt show anything other than i want to grow tomatoes so they couldnt use that as evidence for a warrent dont tell any one take all grow trash to a dumpster in black bags make sure windows and smell are covered and if u do sell some of the extra never from ur house if police come to ur house step outside and ask them what they want no warrarnt no entrace and rember tell no one not even ur closest friend most dont follow this rule but it is safe

First of all, it depends state to state, and if you get busted by the feds or by cops. All of that will determine if you end up in federal court or state court, and the punishments can vary. Generally speaking, the court/police can't confiscate your only home. The police are not in the habit of throwing you out of your home and onto the street in order to confiscate your home. If you have a second home, however, they will confiscate that one. As long as you have somewhere to go, they can take your home. But if you get caught growing in your own home, what they will most likely do is put a lean against your house. This lean is a legal document that attaches to your house (like the deed and what not) saying that you owe the government some $$$. If you ever sell your house, the government gets the money they are owed. So, for instance, if you have a $100,000 home, and the government puts a $50,000 lean against your house, you can either pay off that lean, or sell your house. When you sell your house, the government steps in and takes their money, then you get the rest.

If the cops confiscate your home, they sell it off, usually at either a sherrif's sale, or a general auction. Whatever you paid into the house you lose. The cops take the money that they get from the house, and the mortgage company eats the loss. The mortgage company can sue the police for the money, and sometimes they are successful.

Lastly, I wouldn't really advise going to see a lawyer and asking them 'What am I looking at if I get caught with the mj plants I have in my closet'. Attorney client confidentiality works so that the lawyer can't turn you in, but the lawyer can not ethically advise you on what you need to do in order to get out of a potential lawsuit, or get away with committing a crime. If you talk to a lawyer now, and tell him you are growing, he'll tell you to either stop, or turn yourself in. That's what he has to do, if he advises you anything else, he's legally liable for what he tells you, and can get sanctioned and charged accordingly.

For those interested, look into one of those 'pay as you go' lawfirms. You pay like $10-$20 a month for your lawyer, and you can use him for anything you want. To look over a contract, or help with buying a house, ect. If you get in trouble later, you don't have to pay the lawer, it's kind of like lawyer insurance.

yea but u could simply tell they lawyer ur legal under state law but want to know the consecquences if the state inqnores their own laws which have happened in some cases but the advice will more or likely change

and yes cops care about even small grow ops, ESPECIALLY IF YOU HAVE ASSETS THEY CAN SEIZE. actually they don't give a shit about the weed or the crime, they care about one thing. $$$$$$$$$$$$$$$$$. and they would love to bust you and seize your house. isn't the war on drugs wonderful!

now you may have some legal protections because of your mom, but is she a co-signer or is it her loan? i think if she's just a co-signer you can still have it seized but if it's in her name that may afford some protection. ask a lawyer. also this may vary state to state.
