Open a Non-Profit Dispensary

Anyone in CA know how to open a non-profit dispensary. I have the permit to grow and wanted to know if anyone in here has opened one or is it to much trouble? Thanks for any info

where are you at man need a good dispensery in the central valley... it sucks having to go all the way to the bay or sac.. the one in stockton sucks

im in fresno they have a few dispensarys here i go to one and they have good strains that they bring in from santa cruz. ru in stockton?

  1. Step 1
    Open your web browser and enter the website address of the California Business Portal at www.sos.ca.gov/business/. From the bulleted menu list under the "Business Entities" heading, click the first item: "Corporations." Bookmark the page that opens because it has a left sidebar with everything you will need to use.
  2. Step 2
    Start by either requesting a search for available names, or by sending a request to reserve a corporate name, which also initiates a search. Unfortunately, you can't do this online--you will have to send in a form and wait up to three weeks.
  3. Step 3
    To request a name search, on the left menu of the "corporations" page, click the sixth item from the top, "Name Availability." Scroll to the bottom, and click the link "Checking the availability of a corporate name." Now, click on the link "Name Availability Inquiry Letter form," and download the letter. Fill out the form with up to three names, and mail to the address given on form.
  4. Step 4
    To skip the preliminary search, send a request to reserve your nonprofit corporation name by clicking "Name Availability" from the left sidebar on the "corporations" page. Then, click the "reserve" link. Next, click the link "Name Reservation Request Form." Fill out the form with your first three name choices, and send it to the Secretary of State (SOS) with a $10 check.
  5. Step 5
    Download and fill out your organization form after you receive your corporate name reservation. Go to the "corporations" page, and click "Forms, Samples and Fees" from the left sidebar. Next, click the "Business Entities" link. From the "Corporations" list, click item 5, "Articles of Incorporation (Domestic Nonprofit Mutual Benefit, Public Benefit or Religious Corporation)".
  6. Step 6
    Read the descriptions of the three types of nonprofit corporations, and decide which type you want to start. Print out the corresponding form from the three examples that follow, and start filling it out. Fill in the corporate name you reserved. Write out the purpose of the organization, using any specific language to clarify the tax-exempt status, if needed.
  7. Step 7
    Fill in your residence or business address if you have one for the corporation. If you live outside California, fill in the name and address of a California resident who will serve as agent. Sign the form as incorporator. Mail the completed form with a $30 check or money order to the SOS at the address given in the instructions. Processing may take six weeks or more.

thx clown. you havent happened to open one up yourself have you? i live in cali and there are few around where i live and would love to open one. i have tryed to contact a 420 lawyer but got no responce so i figured someone on here my have some info

no i haven't, I'd love to. i can handle all the paper work and have large scale grower connections but am short on funds for that type of thing.

first get a lawyer, a good one. better to have one and not need one than to be in jail flipping through the yellow pages.

second know the laws in your city and county they will be different

third keep a legal fund account well funded just incase.



p.s. need a partner let me know

lol i have a bunch of people who want to go partners with me but ill keep u in mind. i def going to try to find a lawyer just need to find one in my area instead of one out of town. thx again for the info

I work at a dispensary in Vallejo Ca,,,,,, the owner tryed to open one in fairfield Ca,,,,ya they raided it after 2 days being open......Then another guy tryed to open one right outside city limits of fairfield and they just raided him yesterday...... So be careful man if you try to open one in a city that dosent like them they will find a way to shut you down now matter how legit you do it....It dosent matter if you have the best lawyers and you do EVERYTHING by how the law is writtin...IF they dont want you there they will shut you down period..... We are in vallejo and they seem to just turn there heads and ignore us but if you drive 10 min towards sac into fairfield,vacaville,dixon,suisun,,,,,they shut you down evertime........

Also when you say you want to run a nonprofit its pretty much hard to do that because well how will you pay your bills and have gas money and feed you family??...theres as to be a profit somewhere......I dont care what people say man ive never been to a true "non profit" dispensary and if it was non profit they wouldnt be open long......

Also all the fuckin red tape you gotta deal with and the venders and the city........Alot of citys like vallejo ca and all of solano county REFUSE to issue buissness Lic that say "dispensary" when you go down to get your lic they ask you " what kinda buissness are you going to open" if you say dispensary they say" sorry we dont give those out" lol to give you an idea theres 14 dispensary's in vallejo counting the one i work at and not one of those has a buissness lic that says " dispensary" they do this on purpose so later down the road they can shut you down for Non compliance with zoning laws.....luckly Vallejo dosent have the money to fuck with us and shut down all the shops......But just know at any time they can bust all the clubs for zoning violations........Its there fucked up way of fucking with us.....So far they have only shut down One and that was of course for not having the proper buissness lic that they refuse to issue in the first place lol...lol its a little game they play......Just like solano county violates our rights givin to us in 2003 by the bill SB420 stating that all counties must issue midisenal cannibas cards to people who have a doctors req and apply for the card.....Yet out of the 58 county's 52 choose to comply with these state laws the other 6 one being Solano county just decides its not going to fallow state law........Thats why they were sued in 2009 and they are suppose to issue them but to fuck with us even more they charge 200 bucks just for the card and thats after you pay your doctor to give you the recommendation( just another way of solano county sticking it to us).....So no matter what they will find a way to fuck us over............ So be careful where you open up shop man cause not all counties are created equal!!

To be honest why dont you just open up a liquur store man.....You know how many people are addicted to drinking and smoking tobacco....You can make just as much with out having to deal with all the cops and the city and the red tape.......For some reason its more socially accptable to drink yourself to death and get lung cancer from cigs......Go figure we can have a liqure store and a gun store on every corner in the ghetto but try and provide medical cannibas to people who need it an all of a sudden your public enemy number one......lol just shows you how fucked up our socioty is really......anyways good luck with starting a non profit club....lol

All the dispensaries we've encountered that get raided are from poor planning and improper documentation at the outset. Yes, there is some red tape, but it's not impossible if you have someone experienced guiding you through. www.OpenDispensary.in
what about in county's like solano county where they dont issue busniess lic that say dispensay....what do you say to that then?? How is there a way to be legit when the county wont let you?? id love to know what you suggest ???

Ya thats what i thought.....everyones got a good answer except for when theres no good answer then they just dont respond......

FootClan ---> i give u props for putting things out in the light as few understand the point that you are trying to make. although, it doesn't sound major but often enough those problems u highlighted are often times the major sticking points. over 75% of the info of how to and etc can be found in the search button if these newbies try hard enough.

Bud trading would be a good idea or maybe like everyone grows a different strain to donate to the dispensary then they can get some other strains for free.
 
But youd also have to pay for rent so youd need like donations or like what if you create memberships where people donate buds and they get to get buds for free but the membership would be like for paying rent and stuff so the more people that join the less that they would have to pay so if they bring some friends they would have to pay less everyone wins.

Just like he said, they still are allowed to spend the money they make, but they have to follow strict regulations. Also, this is a big misconception about NONPROFIT and NOT-FOR-PROFIT organizations. True NONPROFIT organizations are things like, schools, churches, red cross, etc. However, collectives/dispensaries are in the NOT-FOR-PROFIT category, where-in, they can use the money to pay employees, owner can compensate himself within reason, and the rest must go back into the business.. every single penny left over must go back into the business and be accounted for, or else your in deep s**t. Also, you must pay sales tax and keep records of every single sale... Just some things I've learned by looking up the subject, because I am very interested in opening one up in my city. Its a long process though man, hope it works out for you... I might try a delivery service first, seems like less of a hassle.
 
Depending on the locality there could be major differences. You didnt say where you wanted to open so its hard to direct you on what needs to be done.

So #1, choose the area you want to start. See if theres other ones there- if so the city probably is favorable towards it. It doesnt make sense to find a conservative area that doesnt want a dispensary and spend alot of $$$ litigating.
