Ok...I went to court and the DA offered me a $100 fine and $120 Surcharge. I asked the judge if this would remain on my record and he said yes. I declined and my court date was adjorned and i have to go back 3/7. If i get a lawyer, will he be able to get these charges dropped or at least downgraded to something that wont affect my future?Ask the judge to speak to the D.A. before you plead guilty or not guilty. (it is very important that you ask befoer you plead, because the judge won't tell you your rights.)
Ask the D.A. for an Adjournment in contemplation of dismissal. (only if you have no priors)
6 months and the ticket will be sealed and thrown out. you will have a clean record again.
You don't need a lawyer.
If you don't have any priors you should have been able to get a ACD on it. I did for a simple possessionOk...I went to court and the DA offered me a $100 fine and $120 Surcharge. as to what stays on your record isn't certain, pretty much all arrests(not including juvenile history) are in the computer somewhere, now those arrests may not affect employment or other matters, but they are in the system on your record. shoulda just taken the fine all it was was possession, you go there with a lawyer, he's gonna tell you to take the plea,Ok...I went to court and the DA offered me a $100 fine and $120 Surcharge. Possession is just an infraction in NY. (even if you fight it, when you lose you still just have to pay the ticket.)as to what stays on your record isn't certain, pretty much all arrests(not including juvenile history) are in the computer somewhere, now those arrests may not affect employment or other matters, but they are in the system on your record. shoulda just taken the fine all it was was possession, you go there with a lawyer, he's gonna tell you to take the plea,
don't know how true that is. I almost didn't get a job for not mentioning a charge I got when I was under y.o.. it was a state job if it matters because even tho it was sealed it still showed up and from then on I know to reports. You don't have to disclose it to employers.
under 25 grams is an infraction. then its a misdemeanor up to a 1/2 lb. then felony from there on. and if your busted growing vegging plants or not they count. any part of the plant, leaves, buds, stems, whatever, Its all "marijuana" in the eyes of the law.Possession is just an infraction in NY. It really doesn't matter on your record. It is not even close to a misdemeanor or Felony.
Do they go by wet or dry weight? Seems like smaller plants would be better than bigger ones in this case.under 25 grams is an infraction. then its a misdemeanor up to a 1/2 lb. then felony from there on. and if your busted growing vegging plants or not they count. any part of the plant, leaves, buds, stems, whatever, Its all "marijuana" in the eyes of the law.
there seems to be some variation out there, probably depends how much of a hard on the local DA has for weed growersDo they go by wet or dry weight? Seems like smaller plants would be better than bigger ones in this case.
