is myspace legit proof for a crime , cause my friend tagged around my town , and his tagging name was in his myspace name and the popo's found him , then found a comment of him saying he tagged. can they use myspace as proof?

I think I recall MySpace being used against folks . . . like that lady who pretended to be a teen-age boy, that upset that girl that offed herself. And U-Tube, for sure.

Your buddy is fucked, plain and simple. Myspace is valid evidence. How can they prove it was his account how about because his name is on there along with his picture, most likely.

They can if his IP address matches where he really lives....
They can't just do it by his photo and comment....Anyone can open a myspace account using his picture and info...it happened to me. But, if his IP matches where he lives then he is fucked....

1. Has your friend been arrested or charged for any crimes relating to this? He should not be talking to the police about anything for any reason. If he has yet to be charged he should STFU. If he's charged, he needs to shut up and let his lawyer do the talking.

2. Yes, your friend's myspace stupidity can be used against him as evidence in court that he is guilty of tagging. The prosecutor could subpoena myspace and his internet provider and link him to the post. In theory, your friend could argue that "Mr.X" came over to his house and used his internet to post the pictures to this myspace account that your friend does not own or control. The prosecutor probably won't go the trouble, however, because it sounds like your friend is so screwed he'll end up pleading guilty and taking whatever deal he's offered to save everyone the hassle of a trial.

3. What kind of an asshole goes out and sprays his lame tagging name on property that doesn't belong to him? If he wants to paint then he should get a fucking canvas.

4. I hope your friend gets busted for this, seriously. Vandalism is antisocial behavior that damages the property of another and it must be punished. How would you like it if someone spray painted shit on your girlfriend's house or something? :finger:

I know the laws against cannabis are retarded, but that does not give you the license to ignore the just and reasonable laws that protect us from each other and ensure a peaceful and stable society.
