legal advice needed

i have a friend that may or may not be under investigation for $1800 worth of copper being missing from his place of employment.the copper wasnt ripped out of conduit or anything like that.the missing copper in question was in a roll on the floor in the maintenance shop.so far only a police report has been made.the reason my friend is worried is that he sells copper from time to time at the scrap yard.well he has heard talk from his employer that they gave a list of all employees to the police to cross reference with scrapyard records.naturally the police are going to see him selling copper at the scrapyard in the same timeframe of the copper being missing.no one has been questioned in the investigation yet but he is sure as soon as his name popps up on records he will be questioned.my friend is very nervous around cops due to previous experiences and is afraid of looking guilty.should he just politely refuse to answer any questions to the detective? does anyone have any advise on how this should be handled?

He'd be one of the first I'd look at too.
That missing copper roll weighs in at around 1000 lbs, not something you can just stick in your pocket. Supposing your "friend" sold around that weight when the roll came up missing, where else could he have gotten it from? If it came from a legal alternative source it should be easy for him to prove, if not, guess who is the prime suspect?

silence! tell him to not say anything. they can't tack on an extra charge for remaining silent.

if he lies to the police it's obstruction of justice.

i can't stand thieves, i hope your friend gets caught...

and stealing from somebody who's giving you a job... that's fucked up.....

ok i reviewed my post and nowhere in the post did i say he actually stole the copper so please dont assume that he did.also the copper cost the company $1800 2 years ago.(so they claim).and to the guy that said $1800 worth of copper would weigh 1000 pounds.your numbers are completly off. scrapyards are paying $3.10 a pound for scrap no.1 copper. that would be 580 pounds of copper.the price of copper wire is WAAAY more than what the scrapyard will give you(3.10 per lb).so in reality it was probably more like 150 pounds of copper.anyway all that is irrelavant.

also greatwhitenorth, all those things you mentioned are only speculation.i really think he has nothing to worry about as all they have is him selling copper.if they want something more concrete the investigators are going to have to find the copper that my friend sold(impossible)and match it with the description of the copper that the company gave them.(also impossible)

Of course its speculation - I don't know you, your friend, nor do I live in Texas.
The 1000 lb figure came from a quick google that indicated scrap copper prices @ 1.80 a lb, and not being a scrap guy myself I used that figure.
Truth be told, I hope your friend is not the one responsible for the loss as I really have no use for thieves other than undercoating for my truck.

My suggestion would be to say nothing and retain the services of a lawyer. You don't usually have anything good happen by talking to the police when you are a suspect.

everyones right NEVER talk to the police no matter what.......If they have the evidence to bust you then your busted theres nothing you can say that will change anything in your favor it can only hurt you not help you........
