In early December I decided to call every day until I got through and talked with someone who could answer my question. It took me over 500 attempts over the course of five days before I finally got a human.

IL businesses already know IL doesn't pay its bills. What they need to do is take all those former driver's license printers and give them to IDPH and rework the MCPP cards to be done by them.

I haven't done it yet. 24-48 hours. But don't run yourself dry before switching, sometimes you get stuck in limbo.
I think anyway you do it works as good as any other.
I have the PDF's filled out and saved for each nearby dispensary. I'll file by email when the one that isn't my usual has something I want, then switch back to my usual with the better every day prices.

Political arms of the police wanted that so dick cops can harass people who dare use cannabis. Run your plates, see MCPP, claim they saw you swerve (like being high makes people swerve). Get to do a field sobriety test designed for alcohol and claim the person failed to try to take their card away. That is all it's about.
Hopefully it will be removed with legalization.

You also can't carry an open container anywhere in the vehicle legally if you're the driver. Just to drive home how much BS that is. Sealed containers from a dispensary and a card would be pretty obvious that you're allowed to possess, same as if you were stopped walking.

Just got off the phone with the guy who processed my application. He sent a deficiency letter because my picture was "too small". However, he had me go ahead and email him a larger copy and my application will be completed today. He did verify that everything else was good to go.

Also, he said that I will receive a letter to take to the dispensary because the card printer is having issues. He said it could be a couple months before anyone gets actual cards but the letters will work as long as needed.

u can for sure drive with it. open and everything. but in a lock box they sell at Cannacare for $30 and its not in arms reach of the driver. This can 100% be confirmed. and i highly doubt they are pulling people over all cuz they have a marijuana card. its obvious if morons are too high to drive. its not an automatic ur gunna be pulled over.. thats like saying 1 dui and now u think all cops think ur drunk
 
So sorry this wait time is still this long for you all. I got mine after 90 days back in December but I like to pop in here and read the threads. Glad the government didn't shut down the application process down. Side note, I spoke with someone at my dispensary about the temp cards. They should be rolling them out in February supposidly. Also ask if they could keep up with demand once they roll these out and it may seem the favorites could be out of stock a while. I recommend to all of you to try black mountain kush RSO for sleeping. Just rub it on your gums or put it on a piece of hard candy.

I would still use caution because I was told different. They said if I open the stapled bag with what I bought in the dispensary it can be taken from me if pulled over. It needs to be without arms reach and sealed from the dispensary. If you are pulled over I was also told to hand them your DL and MM card because they already know you have one from your plates. Not only that but I was told they can take you in for a blood test if they feel they have reason to without your consent. This is what I was told from the bud tender.

It's an awful big state with a lot of backwards redneck areas to make assumptions about all the cops in the state.

625 ILCS 5/11-502.1

(b) No driver, who is a medical cannabis cardholder, a medical cannabis designated caregiver, medical cannabis cultivation center agent, or dispensing organization agent may possess medical cannabis within any area of any motor vehicle upon a highway in this State except in a sealed tamper-evident medical cannabis container.

Compare that to:

(c) No passenger, who is a medical cannabis card holder, a medical cannabis designated caregiver, or a medical cannabis dispensing organization agent may possess medical cannabis within any passenger area of any motor vehicle upon a highway in this State except in a sealed tamper-evident medical cannabis container.

I had my nephew, a high ranking cop, look at the statute. I read it as the passenger can have an open container in the trunk or bed. The driver cannot have it except in an unopened bottle. I compare (b) & (c) and look at the differences between drivers and passengers.
He read (b) and said nobody can have any opened containers. Wouldn't even move on to (c). If the passenger has it in the trunk he's going to be arresting the driver for it.
He then told me to write to the state's attorney and ask how they are prosecuting that statute, and try to get it in writing. But that the answer would only be good for that county.

If we have a bag law I can't find it (doesn't mean we don't have it).

Remember, a police officer cannot search your car without a warrant or reasonable cause. Don't drive under the influence and keep your cannabis in a smellproof container, out of site and nowhere near your person. Know your rights as a citizen and don't volunteer any information that you don't have to.

That's a bit of a snap interpretation. I understand not moving past 625 ILCS 5/11-502.1(b) to (c) when the driver is a cardholder. But if the driver is not a cardholder, then (b) can't apply by its plain words.

Unless he's saying that in that scenario he would charge/cite the driver for common possession, in which case that's really messed up and a gross abuse (imho).

That person told you an outright lie. It does not have to be in a stapled Bag, My Dispensary uses Plastic jewel type bags, but they do not close them in any way. It is the actual Cannabis Container that must be sealed, and Ideally locked in a Box, but if you have a Passenger car, the trunk is legal. I have that, if I had an SUV, i would get a lock box. Make The Police believe you are being compliant in all ways and you have less chance of being hassled.

I work for the state, so I'm only basing this on every other agency that I've been involved with. Every agency that I work around (and I'm in a Chicago building with most of the state agencies) has people that are strictly hired to answer phones. I see no reason why that office would be any different.

McHenry and a Bordering County just Passed that Law you are talking about with the Blood Test, get this, They pull up a Judge on a Video Screen, he views your field sobriety video, and if chooses, issues an immediate Video Warrant to take you in for a Drug Test., but it is also in other areas. I am sure The Nazi's will try to make it statewide, which is why we need it to be Legal.

Technically the card should make it so smell is not a cause for searching. It smells, it gets on stuff. But that doesn't mean cops who are used to using the smell excuse still won't after finding out you are legal to possess.

I agree 100%. I even told him that, pointing out who is the licensed person determines which applies, the driver or the passenger. And pointed out if both are licensed the original container that it would have to be in has a sticker with the owner's name on it.
I mainly wanted a cop's take. Sometimes carrying the law printed out will avoid harassment. Looks like it won't for this one.

He did say about the trunk, if you show you're trying to follow the law they'll generally let you off. But I consider him to be a good cop. I've had run ins with some real dicks.

I couldn't imagine charging a driver with possession of something stamped with the licensed passenger's name would stand up in court. Plus it would only be a civil fine for $200 for someone who's not licensed if under 10g (illegal transportation is much worse for a cardholder).

If I knew how I metabolize it I'd almost rather do the blood test than try to tilt my fused neck backwards and stand on one arthritic foot.
What's another vial of blood? I've got 4 coming out next week and trying to get them to take another.

I don't think this is correct. I think what the law says is that if you refuse any sobriety test related to cannabis, you can lose your card. ("Any registered qualifying patient who commits a violation of Section 11-502.1 of the Illinois Vehicle Code or refuses a properly requested test related to operating a motor vehicle while under the influence of cannabis shall have his or her registry identification card revoked.") So I think you can refuse the test if you want to ... but you risk having your card automatically revoked (guilty or not) and I think the police can still compel you just like anyone else if they have probable cause (DUI law admittedly not my area of expertise).

I don't think you can be forced unless there's an accident (fatality or injury I forget which), that's a blood test.
DUI stops you have to take the field sobriety test or you lose both licenses. If you take it and fail I think you only lose the driver's license for less time (the 1st offense). I'm not sure if you can request a blood test if you fail (or if you'd want to).

That's from memory, I would consult a lawyer before doing anything (plenty of DUI lawyers have pages on this that can be read for free).

I'm not sure about any county laws.
