How bad is this situation?

I'll give you the short of it. Apartment building, third floor apt.. roofers peek through blinds and spot a couple clones in a corner of the room. They tell the landlord, the landlord enters apt *without notice* while nobody home. Renter notices landlord was in there and gets rid of all plants but not in time to get rid of all equipment. Police raid the apt later that day(nobody home) and seize a lamp, a bag of weed, a couple seeds, and a scale. Apt is in a persons name who has never been there and nobody knows who was there growing. Ohio laws in a somewhat large city. What type of consequence is everybody looking at and is this not unlawful entry. btw police have not contacted anybody for all they know a ghost was living there.

Well, I would think that is unlawful entry, but it might not matter unless there is a lawyer who cares., never expect the law to hold up their side of the bargain. I would assume the name on the lease will get a consipiracy for intent to manufacture and intent to distribute, because of the scale. I say conspiracy because if the lease-er was never there, they acted with a person who commited a crime at thier place. Possession will probably stick, intent to grow and intent to sell might not. Not a good situation really. They are going to check the electric bill now and try to pin time back on them too... Not a great situation. I would cling to unlawful entry. Check with your local housing authority on renters laws in regard to owners right to enter without prior written notice. Ouch. My heart goes out to "them"

First thing I would check is if the police had a signed search warrent.

looks like landlord let them in, not they raided. so landlord gets tip>legally enters(im assuming there is a claus in the contract)>sees the evidence and calls the cops>lets them in.

i think you have no worries though, how big was the bag of weed?

Ya, if he let the cops in then you would have to make sure that is legal according to the contract you signed. I still don't think it is legal for the landlord to let the police in without a warrent. I know your just renting it but there has to be a loop hole or something for invasion of privacy. I don't know. Good luck bro. Call a lawyer and see if could answer that.

The police left a copy of the warrant or whatever it was and a copy of the list of items they took. They also left the place destroyed and broke up some somewhat expensive computer stuff that had nothing to do with growing. The bag they found was maybe a quarter ounce of leaves actually, but I think they just classify that as marijauna either way. I know Ohio is pretty lax when it comes to bud I'm just not sure when you factor in the scale and two grow lamps(they destroyed the one they left behind). The "lease-ee" is pretty freaked out at the moment and I'm just trying to collect as much info as possible so I can help in any way. The lease-ee wants to call the police station and talk to them but I said no let them contact you and make sure you have a lawyer ready.

But seriously, you did luck out. Getting rid of the plants B4 the cops came was brilliant. Whoever did that is smart. Give them a pat on the back.

The cops only know the name of the lessee, unless they gathered some info from the landlady or from searching around your shit.
Debating the legality of the search is ridiculous -- you have EYE WITNESS dudes reporting to landlady and she can do whatever she wants if you are using her house as a drug house. So don't even think about asserting your rights to call the cops and debate shit...

This matter is OVER. Move away and carry on...

There WERE NO PLANTS.. you know? If it ever comes up - there were no plants ever...

Just forget about it.. the cops will soon.

Dude, they took your property, and violated your Civil Law Rights, don't you understand what the legal system is all about ? how about badged mafia.. or legal thugs.. there will be a summons there fore, start researching Common Law, get a head start.

Bullshit and wrong. A landlady let the cops in and they took drugs and a scale and broke drug growing gear and computers related to drug growing.

You really think this kid should go Erin Brokovich and fight to get back a bag of leaves?

So RM responds to potential illegal activity by opening door for a respomding officer? I would let them try to prove I existed! An move 5 miles away. Think I heard that is how to lose a skip chaser?

No, it is "going Erin Brokovich" on anyone, it is simply about knowing the laws and what will save your ass from throwing yourself in jail, do a bit of research for the sake of saving time for others, if you want to help anyone, otherwise you can continue to misinform.. prove to me it is bullshit, that is all i ask.

Yeah there is who ever owns the property can allow the police to search, and normally every lease will allow the landlord to enter. let us know how u make out good luck man.

ps also depends where u live and how that county police and da is cause there the ones that decides if they have a case ir not.

Maybe fight for your rights when they've actually been infringed on -- NOT WHEN YOU LEAVE PLANTS IN THE WINDOW.

Dont instigate any confrontation with the police, dont be aggressive with them. however, be prepared with some knowledge and a lawyer perhaps if they decide to get aggressive with you. Good luck man. And remember, you NEVER did ANYTHING illegal and you dont know of anyone you know doing something illegal either. And silence is much better than a slick story.

Best thing to do is call a lawyer, present him/her with the information at hand, and go from there.
Thing is, there's no case right now. I just ran a warrant check and nothing came back, I'm assuming they're just gonna leave it alone but gonna keep my ears up for any signs. Remember this is a mid/large size city with plenty of crime. This is not too high on the priority list.

Well then maybe, for once, this shitty economy might work in one of our favor...lets hope real crime ranks higher on the list of priorities. It may be that its not worth thier time...lets hope so
