got caught with one plant in florida- help

I got caught with one plant in my house because i made 2 of the most dumbest mistake i could have, one i had one picture of my plant on my cell phone, two i gave them consent to search my property after they threatened to arrest my wife and called DCF to take my kid away. Im a 37 year old guy with a good job and a great family, when I heard that my family would be involved i caved in not even thinking twice (i really didnt want my family involved) So they came in to my house and the best was the look of dissapointment when they saw one gangly looking plant that was almost dying. either way I got hauled to jail and got charged with possesion and manufacturing (cop did write on the record that it looks like i just grow it to save money)> Anyone from florida around these posts that have had issues like this in florida. This is my first offense ever and im freaking out of my fucking mind and even having daily puke bouts from the anxiety. Whos out here that has had the same issue? and how did it turn out ?

Get your wallet ready and call an attorney . If you have no previous record the Attny will be able to get this tossed out of court if you hire the right one that is ..Sad to say its often a circle jerk show among prosecutors , judges and attorneys .

I would make sure as well to never cave in again to the psychological games they play , such as threatening your family as they did . LEO will cheat and lie to get what they want by manipulating people of there rights , this is an everyday occurrence for Leo as they are trained in the art .

Psychologically they beat you down and now you need to regain your self and take legal course of action , this will all blow by eventually when said and done and you ll be able to rest with peace of mind ..

First thing is to get a lawyer. Talk to friends who have been in trouble and find a good one. I don't know what the laws are in Florida, but I doubt that 1 plant would be anything more than a misdemeanor. You have alot of good things going for you though. Being that you don't have a criminal record, and you are employed. I would imagine that you should be able to get out of this with at worst a slap on the wrist, but like I said I am not familiar with the laws in Florida. I wish you the best of luck, and just make sure you don't catch anymore charges while this shit is pending.

If you don't have priors, i'd say you'll get 6 months probation and drug counseling at most. They don't care about one plant. It's a money thing now. I liked counseling, it was fun.

Here is how you find the criminal defense attorney you need. Go to the superior court in the county your case will be heard in. Online you should be able to find the dockets. Look for all scheduled criminal cases/drug cases.

Go to court and spend the day listening to different cases and at breaks ask the bailiff and court clerks who the heavy hitting criminal defense attorneys are. You will be given names. Keep asking until several people who WORK AT THE COURT give you 2 to 3 of the same names. Now book appointments with each one and discuss your case.

Do not lie. Do not hold anything back and get ready to pay what seems to you an insane amount of money. But do not cave and go with a public defender. Pay that horrific retainer. Honestly to begin I'd expect something around 3 to 5 grand to begin.

Do not take suggestions from friends or family unless your family is gangsters but it doesn't sound like it LOL. You need a shark. Spending a day and going to the court and interviewing all the workers there will pay you back many times over. A very good CD attorney can make the most interesting things simply go away.

Good luck on this and I am sorry you have to face this.

Ive contacted the new head of Norml. He is a Criminal defense lawyer in my town.

U might get lucky and get legalized if u can drag this case out! Maybe also start visiting a doctor with "severe anxiety" and panic attacks, seizures...whatever else lol.

im in the south too and know a guy that got off with 250 plants...if ur norml guy doesn't work out, pm me and I can get his lawyers info maybe..u didn't have any scales or paraphanelia right?!

Just wanted to give you guys an update on what happened. All charges were dropped with the exception of felony posession of marijuana. the punishment is drug court, which ill be doing that for a year and then that charged gets dropped as well. So the worst case is that I cant smoke for a whole year which blows but my record will remain clean.

Man I checked Norml for your state laws and they suck, I thought mine sucked, but at least it's 4oz before Felony Possession here. Glad it all worked out for you. I like to keep in the know on my laws, so going in I know what the worse case is before hand.

Anyways, I'm in FL and have had two people that i know of (friends of friends) who were caught with plants... one had over 150+ and two large rooms, (got 2 years probation), The other i'm unsure how many he had, but he has a list of priors like a recipe book, and dropped $ like crazy on lawyers n shit, but he also was caught with MUCH MUCH more , AND was involved in a shooting lmfao... Hes out n about as we speak and was picked up less than a month ago on some bullshit VOP...

The pigs ( I mean the cops) ended up in my house because they searched my cell phone and found that I had a picture of the plant, he saw the light in the background and assumed I had a growhouse. I let him come back to my house because he said that if he got a search warrant he would arrest my wife as well and call department of children services because we have a 4 year old son. I never been in trouble and didn't know what to do and I didn't want my family involved. I wasn't pulled over by just a regular beat cop, I was pulled over by undercover narcs so they went fishing on me (as my lawyer affectionately calls it). The only positive part about the story is the look on their faces when they found one single plant, it was the look of shit we have to fill out all this paperwork for this shit (fucking idiots). The part that I hate about drug court is that there are really good, hard working people there just because they got caught with a bag of weed. Florida sucks and as soon as this shit is done we are out of this backwood state

Just write down on the religion thing that you are a Catholic. In Canada I got an absolute discharge way back with a qp. The last time They got me for a few oz's about ten years ago they charged me with possesion for the purpose of trafficking. I beat the trafficking part and recieved a $500 fine for unlawful possesion. They also cut me a check for $700 and wished me luck in future endeavers
