Got caught for the first time what are the options!!

Hey we were on the beach last night in hilton head SC we got busted smoking a chelum on the beach and only one girl actually had the weed on her but we all got busted for simple possession. The cop said we could talk to him before court and set up PTI is this going to be our best option or should we try to get out of it they only caught us smoking not with it on us could we claim we didn't know what it was and we thought is was some herbal stuff our friend gave us. What are our options?

They saw every one smoking the bowl so I guess every one had it in their possession at some point and that's why. But she is the only one that had any weed on her person.

were you just standing in a circle passing it around? if you were thats not to smart , pretty obvious what your doing. next time roll a joint or blunt because then you wont get a paraphanilia charge. its easier to ditch or eat the joint/blunt. then theres no evidence. remember to leave the rest of your weed at home. only have the blunt and nothing else incriminating leave your pipes at home. in my state its better to get caught with 100 or less grams than get caught with a pipe. fuck that, the pipe stays at home

hiltonhead is nice. i lived in walterboro for a while. but yeah in all reality the cop probably knows it will stick thats why he gave everyone charges. because when it comes down to the good ole boy system in the southern states the cop will get on the stand in court and say you all were smoking it when he walked up. and the court will agree.

That sucks what happens if you pled guilty? Never had anything happen like that in cali. Sorry to hear about your misfortune.

its never really a good idea to just go in there and plead guilty. even a public defender can get charges lessened or dropped for you.

i just looked up the laws for south carolina and you should be alright. paraphenilia charge there isnt even a criminal offense they will give you a civil citation (fine) . its worse to have the weed there so its not like my state that sucks but they will probably just fine you i seriously doubt they will try to send you to jail. good luck

Yo. I've been busted twice here in SC lol. Sad stories..wrong place at the wrong time. First time i got busted i accepted PTI but that was before i knew anything, the second time i paid $1,500 for a lawyer and that was AFTER talking her down. PTI after it's over with will run you over 1000 bux easily. It's fucking insane, and then they get this bogus statistic that there's ____ amount of marijuana users in rehab. Like we had a choice. But my record is clean...so i guess the lawyer was kinda worth it. But yea, the pigs should of asked someone to take ownership of the herb and only charge that person..i think you should look into an attorney and fight your way out of it. PTI may actually be cheaper, but you'll have to chill on smoking for a little more then 10 weeks, attend NA/AA meetings, and some stupid ass 'drug counseling' meeting once a week.

Oh, if you just got a paraphenalia charge then don't worry too much, like the guy above me said, 300 dolla.

Exactly!! but that's not including the lawyer if you get one. i don't know the laws in your state but.. if you plan on smoking herb until it's decriminalized you should find a good, reputable criminal defense lawyer. That's if you can afford it of course. But a good lawyer is always your best bet. If they're good they keep your fines and charges to a minimum and delay the trial.
One suggestion is to get your friends you were busted with and find a GOOD lawyer. He could give you a break on the price if he represents all of you.
