Felony cultivation,,first offense,, no priors... How much jail time?

I live in a pretty conservative state. Say i get raided and they find 25 plants, scales, 3 400w hps, $3000 cash and 1/2 lb of kush under my bed, how much jail time am i looking at? I have zero priors and cash to hire a good lawyer. Just wondering. thanks.

Also, what would happen to my dogs in a raid i wonder?

If you have things in your home that might lead LEO to believe you're SELLING pot(especially large amounts), then depending on where you live you could be looking at anywhere from 5 years to life in prison. Keep in mind that in the eyes of the police, a cannabis plant will yield a pound of marijuana whether it's grown indoors or out and regardless of the actual genetics of the plant. Even if you're growing Lowryders 12/12 from seed and only yielding 1/2 oz per plant, they don't care and will still apply their arbitrary pound-per-plant formula.

In some places, simply GROWING cannabis for your own personal use is the lowest class of felony. That's contingent, of course, upon actually being able to prove "personal use". If they have ANY reason to suspect that you're also trafficking (scales, large amounts of cash, ziploc baggies, etc) then it quickly escalates to the most serious class of felony. Depending on how much they thing you've been slinging, they could call in the FEDS. In that case, you're looking at a mandatory minimum sentence of AT LEAST 5 years just for the distribution.

If you're in the US, your dogs would most likely be shot and killed by law enforcement, even if they are the tiniest, sweetest little yapper dogs on earth. Law enforcement seems to LOVE killing family pets. In "self-defense" of course, because we all know most family dogs would certainly lick you to death if given the chance.

Don't go getting all paranoid, its the beginning of the end, acting suspicious and whatnot. I would get myself a good uncrackable safe with the lawyer money. Put the pounds and scales and cash in there. Leave the dogs out though. If possible, integrate the safe into the structure of the house, say into the floor, wall, foundation. 2 safes would do the job, twice as well. keep about 100$ and an ounce in there, and hide it in the likely spots(back of closet, under bed0. If this safe is found, and cracked, they might not look for anything else under the carpet or in the wall. You might wanna get some bulletproof vests for your dogs. These days, cops just love to shoot dogs and plant guns on them. Check on norml for the jailtime. My guess, without the cash, pounds of kush, or any guns, a year or two and fines and probation. Dont quote me on that though. Stay safe

Pretty sure that's POSSESSION, not cultivation.

Most likely 5-25 years jail. You said it was a conservative state. It also matters on how good of a lawyer you got. A good lawyer for this kind of a open book case will run you 15-20 grand. Seriously if they raid your home and you have drugs it's a pretty clear indication that you are guilty. Now it's up to a good lawyer to either sweet talk the state's attorney/ walk circles around the states attorney in a trial.

nah, i havent been busted yet but i got a bad feeling its gonna happen eventually. hopefully ill have about 40-50k buried somewhere in the woods by that time.

this thread has got me thinking though. im going to find a real discreet place to hide my scale like in a vent or something. i would think finding shotguns is a different story then if they found unregisterd 9mm's though. i keep a loaded 12g by my bed.

The question is, is it worth storing your nugs somewhere else other then your house just in case? Like buried in the backyard or at a friends? And is it a better idea to try and grow 5 monsters as opposed to 25 lr2's incase of a raid?

the posession and cultivation fine are the same. Under 100g is 100$ fine and no crim record, and there are no mms, exept for over 20,000g and well, here it is

they still take the chopper out but just pull the plants, and usually don't bust people. its still ohio though, so its a tradeoff.

Stacking charges is what kills people. Steal electricity, thats a charge; anything that could be claimed to "fortify" a window or door, thats a charge; papers, a bong, thats a charge, a gun (hunting, pistol, anything bang bang,) thats a charge; got some pot processed into hash, hash oil, whatever, thats charge.

It is designed to make you look guilty. A big bad guy who needs to be taken out of circulation. They can take your house, do a lot to fuck with you. Drive up the bail so you spend some time in jail.

Your dogs, what they do where I live is open the gate, your dog walks out and bang; dead dog. LEO has lost several civil cases when they killed several clearly friendly dogs, and lost big money. And they STILL DO IT.

Be smart. if you have a big grow separate it from home and anything else, don't keep your money there either.

Whoa, I'm moving to OHIO, for sure! Actually, where I live cultivation for personal use isn't such a big deal as long as you can PROVE that you weren't selling it they treat it as possession and not cultivation (no matter how much you're growing).

anyway, back to the OP.

If you're afraid you're going to get busted, the number 1 thing you want to do is GET THOSE GUNS OUT OF YOUR HOUSE. Growing pot is a felony, selling pot is a felony, and if there's a gun involved it makes it roughly 1000x more serious than if there were NO guns.

If you're committing a felony, make sure there are NO GUNS. Using a firearm in the commission of a felony is a crime in itself, and a very serious one at that.

What you want to do is reduce the number of charges they could slap on you if you're caught. Cultivation is honestly the least of your worries if you've got guns and scales and large amounts of cash in your home.

I dont think the feds can seize your bank accounts though, can they? Maybe if you have 500+ plants or something but i seriously doubt it. So im going to just start making weekly trips to deposit cash into my savings. And I would bet that if you payed 5k+ and got a good lawyer a person caught with a dozen plants or so wouldnt spend more then 6 months in jail. I know where i live our jails are supposedly at full capacity so i would assume that felony cultivation from a nice kid with no priors would get the lightiest sentence possible. You would think. Now, fines and probation time would be over the top probably.

To answer the question of "how do i know im going to get clipped", i dont. But its one of those things that if your operation gets big enough and you do it long enough, it's practically inevitable.
