Cops Searching Car without a warrant

a cop needs probable cause to compel a search, ie FORCE a search on you.

a cop with reasonable suspicion can ask for consent to search.

that's the way the supreme court has ruled for years and years and years and years.....

If they order you out of the car you should lock the doors and put the keys in your pocket (and leave the windows up). It's a lot harder to explain to a judge why he stole keys out of your pocket and unlocked the car himself as opposed to searching when the car was left open. Unlocked and open doors might be considered consent to search, as in "go ahead and search. ill leave the doors open for you".

If he actually has probably cause that will stand up in court he will simply take your keys and search the car anyway.

Your car is private property. That's why a search warrant is required to search concealed areas. Unless there is probable cause. Like a drug dog hitting on a suitcase or a deadly weapon within arm's reach. But, there is no expectation of privacy in what is clearly visible to the public. Like something on the dash or anything in plain view.

The police can pretty much do what ever they want, but if they trample your rights, they will be chastised when it goes to court and everything is thrown out due to misconduct. Never take a plea, let your lawyer do his job, usually in the final moments right before or right after hearings have started the state backs down and drops the charges. Seen it happen a lot. Also seen most people take a plea thinking they are keeping themselves from doing real time. Never consent to a search, and if a police person ever asks if you "Understand" something,always tell them them that you DO NOT understand, even after they have explained it a million times, you NEVER understand. By agreeing with them that you understand something is the same as consenting.
