Can I be denied this job?

I just recieved a call for a job at a grocery store next thursday. I've been a patient as of December 13 (but i don't have my card yet, I've only got my signed papers from the doctor). Could I be denied this job on the grounds of a failed drug test? I'm considering just spending the money to flush my system to be on the safe side. Any advice at this point is good advice and I'm all ears! Thank you

I would assume it would be up to the employer. So I would be on the safe side. Is it mom and pop operated or chain?
 
It's a chain, but I'm just getting an entry level bag boy position so I can't see why they'd drug test...it's just a college job

Hate to say it but they are probably going to test you at least once. Check with them right them a random email sometimes they have employee help lines. Best of luck man.
 
OK the deal is that a lot of COMPANIES that drug test have policies that are set up and won't allow for the use of marijuana. However there was a court case in California that stated that an employer can't refuse employment if you have a medical recommendation. If it is a bag boy job I doubt they will test you and if they do get some piss from a non-cool, non-smoking friend of the same sex and bring that in for your test. Drug test usually aren't monitored unless they are issued by the gov't.

Can you link me to that page about the california ruling?? did you know which court did the ruling (district, appeallate, or supreme???).. maybe its a district court ruling so it might not have a statewide impact... cause under the california attorney general guideline:

Use of Medical Marijuana in the Workplace or at Correctional
Facilities: The medical use of marijuana need not be accommodated in the
workplace, during work hours, or at any jail, correctional facility, or other penal
institution. (§ 11362.785(a); Ross v. RagingWire Telecomms., Inc. (2008) 42
Cal.4th 920, 933 [under the Fair Employment and Housing Act, an employer may

yes you can be denied employment if it's stipulated from the beginning that it's a drug-free workplace. if during the course of you being considered, it's explicitly stated that they conduct pre-employment and random drug tests, then stop smoking weed.

flush that system out.

it's a very unusual scenario because several states have bent over to unions, passing laws that require companies that choose to perform random drug testing to provide drug counseling to employees that give a positive result, instant termination is not possible in these states, and small-medium sized companies don't drug test to avoid these costs. immediate termination because of a failed drug test will only be the result:

if the employment contract says that the result of a failed drug test is immediate termination;
if the employment contract states that you are working 'at will', which means that you reserve the right to quit at any time without penalty, and the employer reserves the right to fire you without cause, pay you the wages due, and thats the extent of the relationship;
or if the corporate by-laws, approved by the board of directors and shareholders, state that drug use is not tolerated...

again, different states have differnet laws, but the general idea is that if you're smoking a shit ton of weed, avoid jobs that include pre-employment drug screening as part of the job description, or avoid big companies altogether.

If you work for a government contractor you're fucked too. they don't allow any drug use, and since almost all fortune 500 companies have some sort of government contract, don't try and look for a career in Boeing or Lockheed Martin while smoking weed anytime soon. it's doable, but the pain in the ass of having to know when the drug tests are coming would drive any normal person completely insane. i know a buddy of mine who pulls it off, at raytheon, and he has to walk to work with a fake piss bag on him all the time, nervous n shit, i swear he's lost some hair since he started that job....

go see your doc get a script for marinol ( idk if i spelt that right ) ask only for 1-3 pills hence there expensive as hellnow when u get homedont take them keep them aroundso whenu have to take a test bring your marinol script with u and they wont even post it on the fax to the company ( or mention it on a call) ive seen both ways done for employers... the test cost 1000'sof dollar to figureout if its mmj or marinol... incase u get fired becauseof it a positive drop you can hire a lawyer and plead your case maybe youll get nothing maybe youll get a settlement... every state is a little different

just wanted to throw my .02 out there...

as a consultant i get tested a lot when working for different agencies and i pass 100% of the time using synthetic urine. order a bottle online, tuck it under your ballsack, dump it in the cup, voila - you passed the wizquiz.
 
I must say I love this forum and all the friendly people willing to offer advice. Thanky you to everyone who posted and I'll be sure to update the outcome of the interview. I did some digging and found out they wont test me, but one can never be too safe.

TRUST ME.. They will swab your mouth with that swab thing and they test for weed, coke, heroin, codein, ect.

I am assuming this is a union job and you need to just spend the money getting your system clean.. but I don't know anyway that you can beat that saliva swab test. I have more info on this if you need it.
