In court I don't think it would matter rooted or not. I wouldn't take chances going over based on that premise.
I would use this advice Leo doesn't care if rooted or not its a plant to them so I personally count clones as a plant.

Law enforcement WILL and HAVE use an unrooted clone as a plant. You can bet that if they get a search warrant then they will do/fabricate anything in their power to not look stupid. Most likely they will weigh the wet plant cut straight from the base, weigh any butter, cooked medibles, wet or dry trim, etc until their weight goes into the several pound territory without a single dried bud in the building.

If this sounds completely unfair to you based on the written law that's because it is. Even if you are 100% legal you are going to have a hard enough defense, if you are in grey area of "my interpretation of the law" you may find yourself in a court room without being able to even use your medical card as defense. Time and time again people have found out that having the card is a "guilty until proven innocent" piece of entrapment. Police aren't lawyers and it will be a painful mistake to expect them to interpret things how you see it should be.

Being 100% by the book by any possible interpretation of the law will most likely let you escape the entrapment in the end but this is after the defense. The MMMP laws are a trap and you should really look at them as a last ditch effort. The people that use this mentality will be in much better shape.
