Long time forum lurker and careful, experienced grower... now that the criminal case is done [and ~$9000 in], I have nothing more to fear -- time to drop some knowledge. Noobs & even confident growers, read up and take heed.. For the important TL;DR , skip to "LESSONS LEARNED".


SUMMARY POINTS:


  • Single-family suburban home, owned by me & wife for 3.5 years; Soil grower; several lovely strains (Blue Dream heirloom, unknown Kush from seed, unknown catpissy strain from seed, unknown Haze from seed), under CFLs and daylight throughout the house.


  • Very private.. only those who needed to know, knew; Private surroundings, security system, fenced-in yard, no nosy neighbors etc.


  • Raided by Wake County Alcoholic Beverage (ABC - whose sole purpose is tax revenue collection, BTW) controlled substances task force, August 15th, ~10:45AM while wife was out of town on business, and I was at work 6 mi. away. Came SWAT style, battered the front door and also a door-jam pet gate to the rear room (which they were too stupid to open), and cut off a lock from my outside storage shed, but didn't fuck shit up too bad otherwise.... still.. fuckin dicks.. I would've just let them in if they'd presented the warrant like fucking gentlemen.


  • SEIZED:
    • 3 bushes and 1 small stalk (flowering), all my CFLs (~400 watts worth) and double-sockets, fan, and cheapo timer from rear room closet;
    • 10 various clones in lowlight semi-stasis from middle room closet;
    • 4 mid-vegging in daylight from living room;
    • all my pipes & Rizlas & empty storage jars, and a sentimental photo I took in Amsterdam in 2001 (WTF??);
    • some crappy old nutes and pesticides (they left the good organic stuff for some reason - guessing they missed them)
    • about an eighth of dried test buds and some trim
    • some other weird miscellaneous shit, like a huge Rubbermaid bin that was in our hallway


  • LEFT (baffled by some of this): small fan and CFLs from middle room, my bud grinder & scissors, some seeds, all the pots & soil, loads of good nutes, other miscellaneous shit


  • Got a voicemail from Officer Josh C Tilton on my work line to call and chat... immediately found an attorney (Important!! -- should go without saying, but yes, you need an experienced lawyer ASAP)


LESSONS LEARNED:


  • From the wording of the warrant and then shooting the shit with the agents when I turned myself in, I gleaned some valuable info (LISTEN UP!!!!):
    • They were (and still are, I'm sure) watching traffic at the only local alternative garden store (Fifth Season Gardening - www.fifthseasongardening.com - the only place around here that sells FFOF and good perlite), taking down customers' license plates, tracking them down, then doing midnight "trash pulls" (i.e., stealing and digging through peoples' rotten fucking garbage) to find incriminating evidence. I fucked up and got in a shitty habit of throwing some dead leaves in the trash once in a while when I was too lazy to go flush them down the toilet. THIS IS WHAT GOT ME BUSTED. SERIOUSLY, IF YOU LEARN ANYTHING FROM THIS, IT SHOULD BE: DO NOT THROW ANYTHING IN THE TRASH. Well, while you're at it learning things: IF AT ALL POSSIBLE, JUST STAY AWAY FROM THE INDOOR GARDEN STORES. THEY ARE APPARENTLY A MAGNET FOR LAZY SHITHEAD LAW ENFORCEMENT.


  • [NOTE: I AM INTELLIGENTLY SPECULATING ABOUT FIFTH SEASON - THIS WAS NEVER CONFIRMED NOR DENIED BY THE AGENTS - THEY PLAYED DUMB WHEN I MENTIONED THE NAME - BUT IT'S THE ONLY TIE TO ANYTHING THAT MAKES ANY SENSE. I HEREBY DECLARE THAT I AM THEREFORE NOT INTENTIONALLY INTERFERING WITH AN ONGOING INVESTIGATION]


  • North Carolina laws, law enforcement agencies, and court system are fucking HARSH AND MERCILESS when it comes to cannabis growers.
    • 3 felonies and a misdemeanor for both me and my wife. My wife had nothing to do with any of it, doesn't even smoke weed, so all her charges were eventually dismissed in the plea bargain. I had to plead to 2 felonies and am now on 12 months supervised probation. If I had had a criminal record, it would have been much, much, much worse.

not only does it screw innocent people like yourself but the garden stores lose customers due to the Cops watching. We had the police trying to pass a law where a person had to show photo ID and have their details recorded for buying equipment at Indoor garden stores, this would have cost the store owners their living and ruined their lives for running a legit business. The law didn't stick tho but the stores obeyed for a while because the police said they must. So the cops will often do illegal things thinking they can to get what they need.

Yep, haven't had a chance yet, but I need to go give the store owner / employees a heads up... I mean, they may be keen to it already from other similar stories, or who fuckin' knows, they may be in on it (?!)... but I feel it's my duty to at least go tell them my opinion on what's going on. They can try to take it up with the cops themselves (harassment or whatever).. But mainly, I want to warn their customers, and if they won't, I will.

I seriously doubt the store cooperated in any way willingly or voluntarily. I mean why would they? Seriously? More like the pork and their mentality told them to just set up and watch. However, what shaky grounds. People engaged in what? Gardening for all they know? Hint hint - buy vegetable seeds and be growing something. The big part, and thanks for saying it, is the early engaging of a lawyer. Then let them do the talking or telling you how to answer.

Oh, and I should mention.... I NOW CAN'T VOTE IN ANY ELECTIONS / PUBLIC POLLS FOR 12 MONTHS. Fuck.

Well, it's actually the Capital city of the state LOL... and the store is very close to a huge University campus. There are other store branches in Asheville, Greensboro and Chapel Hill-Carrboro (all pretty liberal college towns).. can't speculate whether they're under the same surveillance, because in NC, each county has its own sovereign "ABC" agency.

Maybe write a letter tot he newspaper and make the public aware of how the police are wasting tax payer dollars..i am sure there are plenty of unsolved violent crimes and home invasions while these fucking turds are pulling this.

Absolutely! I'm not one to take a raping silently.. Been working on a full-on manifesto since August 16th. May even share it on here when finished...

What about the mail? Did you order anything in the mail that would have made people think? If so did you feel it had any relation to that. I don't have any sort of shop around me and I order everything in the mail. Including my soil...

very sorry for OP's bad time, i wonder what even the Barney Fife's think they're accomplishing with this kind of wasted effort
moral of story, grow shops/stores just aren't needed, i know they have cool stuff and you might get a little extra from your grow
but you can mix your grow mediums/nutes/etc. from far more inconspicuous sources, and you will get great results, and for less money too

i'm sorry for your troubles xavier. some cops have weird priorities. usually pushed by some bible thumping politician or politician wanna be.

for many years, i would have a friend go to the hydro store for me. i would bag any plant remains and throw them into a larger pile of soon to be rotting food and wait until just before the trash truck came. i'm from the - it's better to be safe than sorry school.

i'm a legal med user/grower now but i'm still pretty cautious. cash only and i try to avoid hydro stores. which sucks because i want to support local business'.

I'm wondering what the minimum amount of evidence needed to get a warrant? I mean - do they have to find a leaf or seed to come in? Or can they just see a bunch of grow lights in the window and come in?

Thanks ;-) .. and yeh, the "evidence" for her arrest warrant was basically that she lived there and that it was in multiple rooms in the house. That's where the lawyer helped a lot - getting across to the stubborn-ass DA that it was all mine, and that she didn't participate. She was my main concern - I demanded to take all charges, since the only thing she was guilty of was supporting my love of horticulture and counterculture. <3

I ordered lots of stuff through the mail as well, separately and from various places, but none of the supplies are actually illegal (except seeds of course, which I didn't order), and they would still have to get physical evidence from your property. I don't personally think it's too dangerous .. no guarantees though :-(

The search warrant and final report specifically mentioned observing my car and license plate.. thing is, I had only had that car for like 2 months, and had done nothing sketchy at all.. we go out and do normal stuff, but we don't hang out with anyone that [I think] would be under investigation themselves... so it was pretty clear to me that they saw me at that store and pursued from there.. shitty as it is, it's technically totally legal what they did.

To get a home search warrant in NC, they basically need physical evidence from at least 2 separate occasions. For me, it was finding a couple dead leaves in two bags of trash a couple weeks apart.. I don't know how many bags of rotten trash they looked through during the 4-6 week investigation.. but the thought of it makes me fucking LOL

No physical evidence = no warrant. But you obviously don't want do draw any other attention to yourself, like bright ass lights shining through blinds, etc.
