I just saw this go across the cbc news ticker. Isn't that great news? I guess it's happening more and more. I believe in this particular case, it was a drug dealer/user that was living in Vancouver's downtown eastside. He shared his drugs with his friends and was an addict. I believe it was a charter issue of sending him to jail was cruel and unusual punishment. Mandatory minimums are going to continue to be challenged.

good news...mandatory mins take zero extraneous circumstances into consideration
like health,poverty...
I'm all for the proper sentence for the crime,whatever the case may be,just not lumping everyone's into mandatory mins is another way
to shorten up time the justice system needs to process ....to save a few bucks....of course
with the impending mmpr you can see how streamlining the system,would be a necessity ,once they try and process everyone who doesn't go along with the cease grow and destruction orders....
I think we would also have a leg to stand on in regards to destruction too.....you bought and paid for all the meds you have grown....yourself....
if they want them destroyed then they should replace them at the markets current cost with money....plain and simple.....and or have the lp's that you sign on to accept your allowance for your stock or pay you for it....or credit your account...
then they can ship it back to you and you start with a credit of your storage amount...
anything short of this is unacceptable.

That's a great idea...that will never fly! Can you imagine sinking all that money into a venture to have to turn around and give credit to your first customers? It is only fair...you already bought and paid for it...I don't understand why they expect people to destroy their meds, it's just delusional to think that.

I really think we should be going after the total grams of storage we have and be reimbursed.....at the current market value for premium medicinal marihuana...its not too late either...
just because the government proposes these changes,doesn't mean that they can hold us to it.
What am I gonna be able to do with the 2000.00 estimated dollar hydro bill(catch up bill) I will get come summer...
and for this last crop....I will have nothing to show for my time and effort as far as meds....
They really have not thought this thru...
It should be easy to sue for this kind of stuff.....
When you consider the amount it costs to replace this these are not small sums,,,,especially when you are looking a possible 8 plus bucks a gram price....
In my case I will be out 2250 grams at 8.80 say...so $19,800.00 bucks....
if we all sue for these amounts some bigger some smaller..I'd bet we would get to keep them ...just with my example for 40,000 patients....is 792 million my prescription is only 6 grams/day
but you get my drift....
plus if they wanted to pay out less .. they would have to get all the LP's to prepare actual true cost of production numbers(audited) and thus the transparency that
we all know, would show the true cost associated, with production...and then as patients we would easily know who is a rip off and who is working within actual
standard business practices...as far as profit margins...etc...
just sorta thinking about this on the fly....but I see it being workable....

According to the governments affidavit in the MMAR extension case, the average daily recommended usage is currently 17 grams per day under the MMAR.
 
Hate to say it but Cannadan you don't have a case.

Sufficient notice was given to patients in regards to the rule changes and possession amounts. That being said, the fact that you have left over is on you. If they were to cover your lose, they would only cost actual production cost..Not $8.80 a gram.

Please don't take this as a negative post towards you. it's far from it.

so tell me what made HC renew my permit from Jan 31 to March 31 2014 ?
is that to give me a 60 day window to grow my meds followed by destroying them ?
hypocrisy is rampant and us patients are being treated completely with lack of compassion.

sure sufficient notice was given but many voices were unheard during the hearing process as well ....

only time will tell .....

sorta covered that above ...that with some transparency you would see the true production costs from LP's and therefore a more accurate cost of production....
Plus I highly doubt anyone will be selling to med patients at cost....but rather with a mark up....
was what I produced worth any less to me that the cost to buy it would be....??
and is it sufficient notice?? to those of us who managed to get our licences within a week or two of the MMPR announcement....and have had less than a year to try and fill a storage amount....
There may or may not be a case......but we will see...

This is just the beginning. I cant wait to see when a former med patient and his 12 plants meets a judge. Might even be me
 
Actually, I should not have commented on your case Cannadan. I'm not a lawyer so I'm talking out of my butt.

Sorry about that but know that I'm rooting for you.
