C'MON ARIZONA ! HELP ARIZONA GROWERS TO STOP THE MONOPOLY ON MEDS.
The MPP Group has possibly came in here (& possibly other states) only to help get laws passed that will guarantee them a monopoly & not allow others access to cheaper meds. The Prop 203 measure was supposed to be about patients getting relief but it was illlegally (under AZ Constitution Art. 2 Sec 13) worded to stop the average person from growing their own meds UNLESS they live 25 miles from a dispensary, all other things being equal. Can you imagine being forced to buy from a dispensary ONLY because you fall on the other side of an imaginary line ? This is clearly illegal under our state law.
Please do all you can to help right this wrong done to the citizens of Arizona.

The problem I see is with the wording, no law can grant priveledges or immunites which UPON THE SAME TERMS shall not equally belong to all citizens. To me it sounds like the terms are whether or not you live more than 25 miles from a dispensary. Meaning if two people live more than 25 miles from a dispensary then both must be allowed the same immunity.

I'm all for that but you tell me just what I can do? Sounds like we need a lawyer which I understand is already working on this problem. If it was me I would ask the states who don't have dispensaries like Oregon. If they don't have them why do we need them? Sounds easy to me but that is my opinion. We can hash this over and over but just talking about it will not do us any good.

Tell me what I can do ! So far I've sent letters, posted this same post on every website I can, talked to everyone who will listen. The way to get the word out is to be creative. Use the resources YOU have to come up with some ideas for us all or just do what you personally can. The only action that will stall our efforts is inaction. An object in motion tends to stay in motion, just a little push into the newsrooms around the state would get the ball rolling. If others would copy & paste a similar statement and get the word into every news organization in the valley times a dozens, hundreds, or thousands the state would take notice !

As one person you can do so much. But if more folks came to this cause it would be a totally different ball game.

Getting the word out is important. The next step is PROTEST!

Ok so I have done some research into this........... contact your city senator and representitives because the only way to amend this rule is by statute meaning it must be taken to the house and senate and pass ......I have done this as I ask all of you to do if you are in arizona call your cities senator and representititives and explain that this bill needs amendment and that it favors corporate greed over compassion to the ill.It is the only way we will win .......The people who sued to have the dispensaries open and lobbied to have this bill passed were the greedy corporate deushebags....... us as citizens getting our meds is only a byproduct of their evil plans of profiteering.
Advocate brothers and sisters ......If this fails I am going to have to move out to the sticks to grow lol

Very true! But it is going to be hard to get a Senator or State Representative behind this type of movement!

Good Luck organizing! If you look thru as many resources as you can, it would be hard to find a hundred people who have cared enough to even post on the topic in the past several months. I hope this changes and snowballs quickly. It seems there will be little overall real support among those that it affects the most. I'm keeping my fingers crossed and appreciate your involvement as well.

Well.... start here...

http://www.facebook.com/questions/341277752573496/

answer the poll, make your voice heard...

I wouldn't be asking of you would support the litigation if I wasn't already working on some folks ;)

spread the word, action is coming, quickly...
Hey Bill

Why a POLL?

It needs to addressed! Simple as that!

I would say it needs to be Amended!

41-1034. Declaratory judgment
A. Any person who is or may be affected by a rule may obtain a judicial declaration of the validity of the rule by filing an action for declaratory relief in the superior court in Maricopa county in accordance with title 12, chapter 10, article 2.
B. Any person who is or may be affected by an existing agency practice or substantive policy statement that the person alleges to constitute a rule may obtain a judicial declaration on whether the practice or substantive policy statement constitutes a rule by filing an action for declaratory relief in the superior court in Maricopa county in accordance with title 12, chapter 10, article 2.

Last I looked there were several rules amended through this process for A Dispensary Applicant!!

Arizona Constitution
Article 2 Section 13

Equal privileges and immunities:
Section 13
No law shall be enacted granting to any citizen, class of citizens, or corporation other than municipal, privileges or immunities which, upon the same terms, shall not equally belong to all citizens or corporations.

Would find the 25 Mile Rule Unconstitutional by filing an action for declaratory relief in the superior court in Maricopa county!!!

Solved!!

I got a question, again. Since the 25 mile rule is written into prop 203, wouldn't you have to get the original prop amended, rewritten, then voted back into law?

If 1 part of a rule or law is found Unconstitutional it can be amended!! Not the whole Act just the portion that is Unconstitutional!!

I hear you there!! Alot of talking and NO walking!!!

If groups were in it to get the 25 mile rule amended it would be getting done!!

There are FOLKS trying to prolong the "25 Mile Rule" movement until dispensaries open!! What is that all about?

Your inability to understand the other side of the coin is most likely directly related to your inability to understand AZCS and/or myself. Blinders, big ones. If people, individuals were interested in getting the 25 mile rule removed it would be getting done. "a lot of talking no walking" sure fits what YOUR doing doesn't it, you know what they say about glasses houses, careful who's feet...blah blah blah..insert any old adage here...
You seem to think it's everyone Else's job to do things for you while you do nothing but complain about it.

"we cannot expect to solve our problems with the same thinking we used to create them" A.E.

Meanwhile back at the ranch, there is action happening, your to busy being spiteful and showing ill-biased contempt to notice or participate it would seem at face value. Guess you can just read about it after the fact.

For those looking to actually do something, find one of the websites, groups or answer on social networking site, participate in the poll questions. Be part of the solution.

the facebook page had over 300 members added within the first 48 hrs and is till growing, website in the werks, 888 #, advocacy office headquarters established other supporters being brought in as I type. The gears are already turning and will soon be at full speed. A section is being added to our forums specifically for this task and ALL updates and progress reports will start and end there. We simply cannot have a multitude of sites trying to organize this thing.
