i have some formal complaints. gave out a bunch today. sending in mine tomorrow. there were copies floating around somewhere on the net as well.

This bugs the question; Is a garage considered a locked room then? Or does an individual need to build a room with a door that has a lock on it.. inside the garage?!

A garage would be considered a locked, enclosed facility IF you have locks on it..

Tomcat, you say liar and I agree, but I wouldn't want to be the caregiver burning through legal fees to fight his lie. It might say different in the law but I think certain judges and PA's would use Schuette's opinion rather then follow what is written in the MMA. I mean, look how the COA just ruled.

This is going to have to go to the supreme court. Wonder how they will rule?

They are working towards privatization of caregiving. Just wait and see.

so whats the deal hes not supporting the small grower? if you have to have a separate locked room for each patient and have say five patients then thats a real big grow. perhaps we need to show him what a monster he has created. Everyone could do five rooms and run 20000 watts and grow 8 foot trees. he should think about what hes doing hes making the grows bigger not smaller.

Correct me if I'm wrong, but the COA burned this guy because he had more than any 1 caregiver is allowed. As for the 12 to a room, thats just an opinion, not case law or better yet, THE LAW. Someone please show me where it says only 12 plants per locked and enclosed facility? Was it Midland where some dick judge concluded or declared rather that the MMMP in it's self is unconstitutional? Well really, then has the MDCH/LARA quit cashing checks, issuing permits, and contact all of the participants with ample time to comply? Anyone get that one yet? How about refunding all monies from permits, investments made in good faith, and kick some on top for general inconvenience, finally firmly insert it up your ass. It's our law and we're keeping it.

That is correct. There is no law against anyone having their patients grows in the same room. Only more than one
cg/patient in the same room. And this is our law and it will stay.

If the garage is locked, and used for no other purpose than the grow, and no one enters than the cg/patient..it's fine.
If the garage is used for other purposes as well..I'd have a locked room inside the garage for the grow.

In the case cited..the problem was there were too many plants for any one caregiver,as someone pointed out.

There are no rulings on how someone legally growing as a caregiver, must separate each patients plants. But, that is being actively discussed.
Every thing from completely separate rooms, to simply tagging the plants with the patient's name is on the table.

Completely separate rooms would make growing efficiency suck. Something as simple as tagging the plants for each patient would be easy.

Our current group of elected officials will push for the "suck" option...
