that would be a tough one considering kill stays in your system for a while. they wouldnt know if you were high at work on your forklift or if you were high at home.

In a lot of federal MMJ trials they prohibit the defense from even saying the phrase "medical marijuana", if the defense tries to use a medical defense the prosecution objects and the judge makes them stop and eliminates the statements from the record. This bill would put a stop to all that.
I am aware of this and that's what I was pointing out in my post, I was also pointing out that you could vote not guilty for whatever reason you want already and most people are unaware of their right as a juror. I could acquit someone who had a hundred pounds because I don't think plants should be illegal or Because the guy seems nice or because I think it would be a waste of money to incarcerate him, as a juror I can currently find someone not guilty for whatever reason and not be obligated to explain my decision or face any penalties for making it. Most people are unaware of their power as a juror.
Yes this bill sounds because it would allow the defense to cite MMJ in its case.

Its not like he dropped bombs on a bunch of people or radiated everyone or aborted a bunch of people or put chemicals in the food and water, I don't see why your so offended. He said people would grow more pot- Sounds like economic stimulis, sounds like a better plan than anything else i'm hearing about, At least some people still have a desire to produce something, better we grow our own than offshore this industry as well. Some people act like California should be ashamed of growing a ton of bud. I believe the opposite, we should be proud of that.

I'm still glad people voted down prop 19 and prevented the off shoring or corporatisation of the industry. I hope this states rights bill passes but I doubt it will.

Actually, these new pro-medical mmj bills are getting a lot of bipartisan support because of the emphasis on states rights. tea party folks support them.

I know the people want it, I just find it doubtful that the feds will allow it to happen, given the ongoing issues with states rights and immigration and the TSA sexually assaulting people and states not being able to stop it, I don't see anything much positive happening for states rights issues but I hope I am wrong and peoples rights are recognised.

Congressman Sam Farr has just authored a bill that would make it legal to use medical law in a federal drug case.

If passed, for the first time juries will be able to find defendants not guilty based on state medical law superseding federal law. Fuck yeah!

If you thought Cali grew a lot of bud before, just wait until this passes!

Can't the jury just use "nullification", their conscience, and vote no anyway? Maybe it's just me but I don't understand why more juries don't do that.

A judge can force the defense not to mention medical cannabis in a case. There have been several convictions where the jury was completely unaware that the defendant was involved in medical marijuana at all.

I remember one case of a jury protesting their own verdict after a case because they were unaware the guy they just sent to prison for dealing was actually running a dispensary.

Of course a jury can vote however they want, but this is more about the right for them to have access to all the information. The part about declaring it valid for a jury to vote not guilty on grounds the defense was not violating state law is more to set a legal precedence that medical marijuana state law supersedes federal law, making it harder for the feds to prosecute at all and allowing the defense to remove any doubt from a juror's mind that it is ok for them to vote not guilty based on state law.

Not my preference, but I have no problems wearing the appropriate costumes in situations. If you show up to a meeting in a suit people are going to take what you have to say more seriously than if you show up in a tee shirt with a pot leaf on it. I get that and play the game accordingly.
