Im drivin , pulled over for tailight. Cop assums im posessing something i shouldn be.
He askes if anything he should know about is in the vehicle. You say no.
now he askes real nice, may i search the vehicle, you say no, i rather not.
BOOM, thats probable cause man. now he says ok, well step out the vehicle.
pats you down, tells you to eather sit the curb, or in the back seat of the trooper..
now anything he finds, your gonna get eather detained, or a ticket.
(this is ofcaose for non med patients) Now court, hoorah!! for court, lol
lawer, and court fees, just to get you case dissmissed, still looking at 1200 in fees.
but o man did you know your rights or what. you used you 5 and 6th ammendment.
and where did it get you. 1200 dollars in debt. lol

as oppose of letting him do his job and getting a warning and going home safely.
thats the justice system, trust me, been there done that, i was the same way.

You have to understand where i am coming from. You might have had someone else in the car at some point and they might have stashed or dropped who knows what in the car without your knowledge. Lets say that a pill of E was somehow dropped and the cop found it, you would be real pissed and in jail right now. Or how about a plastic baggy with residue...meth maybe, anything could have happened and its never a good situation. Not having anything to hide is no excuse for giving away your rights. Claiming your rights cannot also be used to further a Police officers " Suspicion" ,it CANNOT be used as a basis for a search EVER! The Supreme court upholds that ruling all the time.

I've read your statements and I somewhat agree, depending on the situation and how I felt at that particular time. For the most part, guilty or innocent my response to a physical search of my property or person without giving me probably cause, and or a search warrant would be NO. Handcuff and arrest me, inpound my vehicle, and lay the fines and attorney fees on me. There is too much citizen abuse in law inforcement activities. Law inforcer should be cautious, understandably so, but sometimes they pick on people because they can, or they suspect because of appearance. Young people being pulled over all of the time just because they are young. Profiling because you look different, their sporty vehicle, more than 2 males in a vehicle, because of their race are all common practices. The first thing a person should be told is what they are suspected of doing wrong. Just my 5 cents worth

I'm only 27 and that was kind of my fear, because I even look young for 27. I usually pass for 22... But who is a cop to legitimize my illness, he's not me. Honesty was my best policy... and that's part of the reason why I got legal in the first place.

thanks for sharing the story man. glad you made it out of there ok. good job at being cooperative and polite, i've heard so many stories from my uncle (he's a police chief in Yale) about how people get all snippy with cops when they get pulled over...that just makes the cop look for something to fuck you with. i've been pulled over quite a few times, only got a ticket once. polite and honest...well, honest to a certain point...is the best way to go.

I agree bud, they had the right to pull me over in the first place... no need to throw gas on the fire. And the police officer was very polite, and professional. yeah, totally agree with ya. ive only ran into one asshole cop. he was a county sheriff, i was going 10 over in the rain. he pulled me over, i told him i knew i was speeding, he asked for my license and registration...so i gave him my license, registration AND proof of insurance, since thats what you do...he literally threw my insurance paper back at me and said, "did i ask for your insurance?" i said sorry and he went back to his car and just gave me a warning and told me to slow down in the rain because its not safe, i told him my tires are rated at 75mph in a quarter inch of water lol, i dont think he liked that....then he said he knew my dad and was going to call him and tell him, like i gave a fuck..i was 19 at the time, but he never called anyway. fucking prick.

in vegas, you wouldve been arrested(even if you had your card) for marijuana DUi. Same kinda thing happened to me, but i got arrested, and spent the night in jail..charges were eventually thrown out, but that was 24hours of my life i'll never get back. The cops out here are fuckin assholes, and treat pot like its meth. i avoid the cops..wont call them even if i need them.

A good many cops are on a power trip. not all. long story short. Got pulled over for speeding cop had a attitude from the start after giving info he had me get out of the car. had me move to the rear of the car then asked if he could search my car. I said not without a warrant. he went to reach for the handle and I hit my remote door look. he says I want to look in your car. fine get a warrant. he say I can arrest you. I say go ahead I would love to sue the city. then I told him to call a shift supervisor. Boy he was pissed. he went back to car and called someone. when he came back. he said he was going to let me off with a warning. I laughed and told him to feel to write me up for 4 over I would love to see him in court so I could give the judge all the info on this stop. Had I had anything in the car I might not have been so bold. Who am I trying to fool there's a reason I have more then 60 tickets. most of them I had coming.

I have to agree that most times when we are stopped by the police we are stopped for a reason. We did something to draw their attention to us (intentional or not). They are just doing their jobs to protect and serve making sure that we all follow the rules (still some can be macho assholes). I have noticed that a lot of people are being pulled over for vision obstruction, what the heck is that, and why so many people are getting nailed for it? Based on the local community paper in the police blotter section most of them end up being arrested for intoxication or some type of drug possession. I want to avoid vision obstruction, but I'm not sure what it is. My windshield is not broken and I clear the snow and ice from it while driving

vision obstructions would be anything blocking your view through the windshield. i used to have a shitload of those car fresheners hanging from my rear view mirror, they blocked a good portion of my view....i got pulled over for vision obstruction, let off with a warning though, just took em down right then. a cracked windshield would also be vision obstruction. cops use it for a reason to pull suspected drunks over all the time....well, at least around here they do.

Yeah, like I stated, depending on the circumstances. I say this because 95-98% of the time I would not have anything illegal in my vehicle so I would be comfortable going to jail if the issue was pushed to that point. The 2-5% is because of outside influences, what someone else may have on their person while riding in my vehicle. It's not like they could hold me more than a few hours if they didn't find anything to nail me on. I understand that they have a job to do and I would be on my best behavior, I just would not "agree" to a physical search of my property. I know that sometimes you have to play the game to avoid being inconvenienced (time, money etc.), other times you might want to take a stand. Then again at another time and place I might surrender, not likely

And obviously I'm back at my computer But man I'm kinda shaky because I was so nervous... Anyway, I'll try and explain as detailed as I can but I need to get away for a few minutes and relax, lol.

So I suffer from severe migraines and I smoke in my car in my garage because I don't like to smoke in the house because of kids and other personal reasons. So this morning I did just that because I was close to calling off of work because my head and neck were hurting so bad.

Anyway, on my way to work I got pulled over because the tabs on my plate were expired. At this point I was getting a little paranoid but decided to fully cooperate with the cop considering legally I shouldn't have anything to worry about..

SO the cop comes around and here's how the convo went.

Cop: Hello, do you know why I pulled you over?
Me: Not really, Sir. To be honest.
Cop: Your plates are expired...do you have license, insurance and proof of registration?
Me: (hands cop all documents asked for)
Cop: Do you have anything in your car that I should know about?
Me: Nothing Illegal.
Cop: .. Nothing Illegal? Ok sit right here, don't go anywhere.

- 5 minutes go by as I'm freezing my ass off with my window down and my car off and my hands on my knees -

-Cop returns -

Cop: Do you mind if I search your vehicle?
Me: Uhh... No sir, if you want to. (bummed I responded this way...but I was nervous and froze)

- At this point I step out of the vehicle and I agree he can search me. He pulls out my wallet, my personal cell, and my work cell from my pants and then asks me to sit on his bumper. At this point I speak up. -

Me: There is a small amount of Marijuana in the car but I'm a medical user and have my card in my wallet.
Cop: Ok. Because I can smell an obvious odor coming from your car. How much is a small amount?
Me: About an 1/8th of an ounce. Maybe a little more. There's a tupperware container on my passenger seat and a grinder in the door. And a pipe in the center console.
Cop: Ok any knives, guns or anything else like that in the car.
Me: No Sir.
Cop: And you said your medical card is in your wallet?
Me: Yes Sir, there's also a physicians certification behind the seat.
Cop: Ok sit tight for a minute...

Me: Sir, can I sit in your car...it's freezing out here. (sounds crazy, but I was fucking cold)

So I sat in the cop car for about 10 minutes while the cop and another cop talked right outside of my car. He came back and asked me to still "sit tight, we're trying to figure out how to handle this. This is new to us.."

So right there (in my head) I was like "FUCK!.. It's NEWER TO ME!"

Anyway, after 5 more minutes he opens the back seat door and lets me out. He hands me back my ID, Medical Card and Insurance and says:

Cop: Ok grab your Marijuana and wallet off your trunk and have a seat in your car. Turn it on and turn on the heat if you want to keep warm.

So I sat in my car and waited. He came up to my car and handed me a waiveable ticket for the tags on my plate that I can get fixed within 2 weeks without a fee. He said he appreciated my cooperation and I shook his hand REAL hard!

I feel a little liberated right now... I had 1/8 of weed in my car, a grinder, a half-smoked bowl, shake on the floor... and all I got was a waiveable citation for the tabs on my plate.

I just wanted to share this with anyone that has any fears. I know I did, and I wish I wasn't my own guinea pig!! Now I gotta go relax....

You do bring up a good point however. All the cop has to do is run you through a field sobriety test. If you fail you can still receive a DUI. At this point it's entirely up to the cop's discretion whether or not you pass. Still beats a field test kit or whatever it was they were talking about trying to introduce several months back.

Alcohol not only effects your judgment but it also effects your vision as well. Cannabis doesn't effect your vision.. well, not nearly to the point as
