What happened in your case? How many plants?
First off let me say there was no creditable evidence to get the warrant. It was obtained in a illegal fashion , thus hurting the case. I was able to get a jump on the authorities based on picking up info off a scanner. I had many many many plants going, but 14 hours later all they got was 4 small clones that i was not going to burn. I burned all other plant material.
There was over a pallet of new dirt, and hundreds of pots with root balls only. Seeds, food, trays, everything but lights and lots of palnt material. On that site was a camera that really hurt me as it showed some areas in full bloom. If they would have come just a few hours before i would have been doing fed time. The person who informed knew i grew, had no idea where or what scale. Thinking they needed a solid case was not going to happen. They tried for hours to get to to incriminate myself, this never happened as i spent hours learning you can never say anything to a cop to help you.
They never caught me on my property, never got a huge hit, but 3 weeks later they came with some trumped up charges, Bonded out and that when the sharks (lawyers) came around.
The pot charge was nothing though, even with the remanants they recovered from the burning of the stuff. Where they got me is all the other charges they stacked on me over the next few weeks.
The DA wasnt going to let this one go, they wanted me under the jail. In the End they had 3 felonys on me 2 2nds and 1 3rd. and several misd. a-b grade. Since the majority of the charges were trumped up to hassle me for covering that all up they had no choice to give a plea.
I got 180 or 60 actual days in jail by holding my ground and knowing the law and statutes that govern search and seizure. I cant tell you all the details but they really put it 2 me. Just never expect them to abide by the laws they use against you. I also want you to understand they see growing pot as a much more serious thing then you and i see in most states.
