Northern Calif. Town Bans Medical Marijuana Shops

RED BLUFF, Calif. (AP) -- A small Northern California city has banned medical marijuana growing and dispensing, a move opponents say will bring lawsuits.
Red Bluff's city council approved two measures Tuesday night restricting the drug. The panel voted 4-1 to ban collectives and cultivation and unanimously passed an emergency ordinance to immediately prohibit dispensaries.
Most of the two dozen people who addressed the council argued against the ban, saying it would violate state law.
State Justice Department guidelines assert that doctor-certified patients have the right to grow medical marijuana and form collectives. But at least two recent state courts have determined that state medical marijuana laws do not necessarily pre-empt city zoning regulations.

damn, lets hope this doesn't create some kind of loophole for more hesitant counties or cities like my own. cities do have zoning rights though, that's legit

damn...while I agree it is a step backwards, red bluff is extremely conservative, especially when compared to next door neighbor, redding. I think we will continue to see small, ultra conservative enclaves like red bluff, los gatos, etc that will ban them outright but I dont think they can legally ban private growing, however.

my own county, nevada county, doesn't have a compassionate care dispensary either. A neighboring county does, and I've seen so many sick people in there that have driven over 100 miles to get their med legally. Right now there is a moratorium on dispensaries as the 'old boys' are still on the city councils here. But I know that will change. Call me an optimist.

At the same time, our District Attorney is pretty cool about people who are growing with presciptions within the 6 plant guidelines, even stating that Law Enforcement isn't going to bother 'small' collective growing ( around 3 or 4 people growing together.) We've had some big busts here in the last month though - people with 100's of plants, guns, and money. And a couple Mexican Cartel grows as well.

I have also heard there is no outdoor growing in the town of gridley in butte co. My moms friend lives there and is extremely poor and cant afford to buy her own.

Yes, I also heard on KCHO that the city of Chico banned outdoor growing because of complaints about the 'odor' from neighbors of growers.

I don't like the smell or smoke that comes from our local coffee roaster. Do I have a right to shut them down???

red bluff! Lol, the smallest town I ever got stuck spending vacations in with when I was growing up. I tried to score acid one summer in highschool and the whole town found out.

KVMR - best little radio station in the known universe. It was on KCHO that I heard the story of 'no grows' in Chico city limits. Here's a link to one article I found - having trouble finding the actual passing of the law at either the city council site or butte county site. But this is a good read about the 'problem.'

I dont see how female marijuana odor can trigger asthma, Ive had it since I was 6 and Ive never experienced any problems. And I dont see why cities get to pass these ordinances contrary to state law. Shouldt all it take is for somone to sue the city or county and the CA supreme court would set a prescident on that matter once and for all?

well, for the sake of argument...states are passing MMJ laws against Federal law. So it follows that Cities might pass law against State law.

But hey, who wants to argue?? This is a really interesting case, and it's way beyond the legal outdoor MMJ odors ~ it's a huge Rights issue. Very similiar to Cigarette Smoking in public places Laws. Which also varies from State to State.

I think the CA supreme court is going have to decide if cities can violate state law and totally outlaw any growing, dispensaries, etc. Only the appellate court has ruled that they can do it if their zoning laws state that any business has to comply with federal and state laws. Hope they decide that the nonprofit dispensaries are not "businesses' in that sense, and are legal no matter what the stupid zoning law. We'll see.

My dad and his girlfriend live in cottonwood CA next to redding and they told me there is a moritorium ban on growing. Havnt really validated that claim but I wouldnt be suprised if its true. Incidentally I live in district 2 the most conservative area in california and they have no problem with medmj growing.
