Seems like a pretty good idea to me.
The only issue I can think of is what the other dude was talking about.

Who is liable if the machine fails and someone goes out drinking and driving or potentially kills someone?
A beathilizer really has limited impact on the decisions drunk drivers make. Whether you're at .08, .11, or .02 99% of the time you have your mind made up before you even start drinking if your driving home or not. A breathilizer may give you peace of mind or the people your with peace of mind; but anyone who puts their life in the hands of a cheap little gadget with the intent to blame the test if it's .02 off and you ended up with with a dui at .09 needs to load up a bowl, sit down for a coupe hours, and really analyze their life. Beathilizers are tools created to confirm your drunk after you already are not to help you determine how many more your body can take before getting behind the wheel.

She did say when I was talking to her that I wouldn't be liable, but I think I want to ask her more on that subject. But it is for entertainment purposes and should be used as such...Maybe that will be my disclaimer.:mrgreen:

I definitely will give them a call as soon as I am feeling better, I just had a knee surgery yesterday and my mind is not quite right with these painkillers they have me on haha.

I guess a disclaimer would be the simplest way to avoid liability. Just put a sign on all of the machines and that should take care of the legal aspect of it right?

I would definitely not go for it, too much start up costs, you could setup your own little newsagents or something for that kinda cost, or even a sandwhich van that delivers lunch to industrial units.

You could have your very own business that you don't need to pay anyone for,

franchises are seriously seriously bad news,

i trained hard to be a driving instructor here in england, i paid 6000 usd for the training costs, which got me qualified, i then took on a franchise with the british school of motoring, which is the most esteemed driving school in the uk. Franchise costs were high, and initially i earnt amazing money, sometimes 2500 usd per week, but that is to hook you in and tie you down, as soon as they got what they want the business dies out and i was still liable for the franchise fee. If i had instead started for myself at that point instead of franchising i woudln't have anything like the amount of debt i have now.

There is one very important thing to remember about franchises, if there is an amount of money to be made from doing this, why are they not employing and taking the profits for themself, the hassle obviously outweighs the benefits to them and they can make more for less by franchising it out

There is a thc testing kit available on the market call cannalyze, it sells all its benefits to you, and then in fine print it says this is for novelty use only, accurate results can not always be guaranteed, which basically told everyone it don't work so no one buys it,

a similar thing applies to putting a disclaimer on it, if people saw it whats the point in buying it, its not going to give me an accurate result so whats the benefit

i also think that the company will say just about anything to make a sale, most sales people do, but if it really came down to it, you think the company would take liability for it, when its not actually their business that installed it, it would have been your business that installed it

I am always looking for good stoner jobs and self employment. Well the other day I ran across something that I think has potential. It is putting breathalyzers in local bars, clubs, anywhere that serves alcohol. You give the bar owner a percentage of whatever you make. Usually 30%. Minimum upkeep, they run on regular straws. 24 month warranty and service. So basically it would take a little leg work to find locations but once your in it would seem to be self-running. I called and spoke with them and she said that to get it up and running with their franchise name is under 10K, this includes 3 machines. She said any other machine would be sold at a discount. She said each machine yields an average of $500 a month. She also said bars love them because it helps with their liabilty insurance. I don't know but this sort of looks good to me.

i've been to the bars that have them. no one uses that silly box.

I owned lunch wagons....once upon a time. I did not enjoy 14 hour work days, and that is what they were, 14 hours of hard work every day. I used to keep my body in peak physical condition just to sustain at work. Very hard, very hard indeed.

That is a good point but putting a disclaimer on a product doesn't mean it does not work.
If you put something in the area of "this is for novelty use only in no way is it an indicator of whether or not you are able to drive" or "we hold no responsibility for your decision drive under the influence this machine is for novelty use only"

it would be pretty hard to produce a specific disclaimer that would absolve you of any liability without saying it is not a good indicator

Literally every sports bar he went into said they didn't object if they got their cut and wouldn't cost them any money...So, I called the franchise lady and talked with her more, she is basically going to charge me for the machines and the contract for my area. She won't sell any more machines in my area. Well I have been looking online and I found a couple places where I can buy these outright for cheaper. I just won't be guaranteed not to have competition, but, I like competition...bring it on! I think to save money I am going to buy them outright, I think....
Anyways, it is looking good. All the sports bars were very receptive! So I am starting to get excited, this could work...:peace:

Awesome! Glad to hear it! As Tryingtomasterkush said, keep us updated. And Baltimore is a beautiful city, I spent four days in the Inner Harbor area last August and I had a wonderful time. I got to see my favorite band/singer in the whole wide world when I never thought I'd have the chance EVER.. But that's a different story for a different time.

Yes, I did ask her. She said there is a disclaimer on the box saying it is for entertainment purposes, etc....I had slot machines once in a pizzeria I owned and there was a disclaimer on them as well, basically saying that they don't win money....I paid my patrons though! That is what made them come in and eat my pizza, lol....So, I think it is along the same lines. :peace:

if you think its a runner, and you get the machines yourself, then go for it on your own, i'm not sure you need the franchise, you'll be paying them money for nothing really, its not like they are handing you contracts or anything, and then maybe down the line when you've built it up and got contacts you could look into bringing other people in on a franchise.

its only what they have done already

This is what I am thinking too...They do have one major perk though, they finance....I did go to several banks yesterday and talked with them. They are encouraging me to apply for a business loan. I was told the banks are starting to lend again for small businesses. We will see. If the franchise gets me it will be because of the financing. If I can get the loan on my own, I am doing it on my own.
When I was out yesterday I hit some major sports bar down here. A few had the machines and I was told they fill up before they are emptied. Several of the bar owners told me they are a hit. That raised my spirits, for sure.:peace:
