Busted at a time of happiness

Okay, well here is the deal, I have a court date in around three months and in that time I`m on probation. I was sitting at my apartment smoking herb when I get knocks at my door, thinking it`s my buddies who were coming over I open the door they jump in and do their shit yelling commands and that shit the police do. I jumped back quickly, I`m sure you all know how surprised you be, and I just put my hands up as in saying I surrender, I give up, or what ever. I suppose they take that as some sort of thread now and tackle me to the ground cuff me and what ever. Now not only do I find that bullshit, but they found around half ounce of weed and baggies laying all around not to mention an unlicensed gun in my room drawer which isn`t mine, but a buddies, so I`m not sure what they`re going to do about the gun. But what I`m finding bull shit is that because they found baggies around my apartment, they`re going to try charge me for dealing.

Total bullshit.
Now, I`m not sure if I`m going to have to serve jail time for this or just a hefty fine.
Now the thing that sucks ass about it is that I was planning on moving to Maui in not too long, I was talking to this guy and we came to an agreement on an apartment which I find is a good deal.. so I was just going to pack my stuff, get a plane ticket and be on my way in around a month.

Now I have to stick around for this bull shit.

What state are you in whee you got busted? thats the most important thing. also if it was jsut a half oz it should get tried as personal use not intent to distribute. Im no lawyer but the gun would be the only problematic thing depending on what state your in. Most states dont have gun registration/licencing.

Ah damn Canada, sorry bro no 2nd amendment rights for you i guess, the gun should still be your only problem, get a lawyer fast, also look into filing a complaint against them tackling you and shit when you obviously gave up. From my exp most cops will get scared right there because (at least in the US) them doing that just negated any charges against you. I got busted with a quarter once and they couldn't charge me cause they called me a dumbass pothead lol.

It depends on the judge man, I have a friend who got off with only community service and he had a half pound. For the amount that you had you wont be seeing jail. But with the gun added into the situation, i dont know what they will do about that.

I`m not sure if I could get charged with that though, it`s my buddies and I haven`t touched the thing at all, he just had it over one time and didn`t take it home, I didn`t move it he just told me `keep this here for awhile`.
So idk man..if they do it for fingerprints, I don`t see how I can get charged for it.

i would not worry about the weed its the gun id be shitting my self about did you pick the gun up? did you know it was there? if you did not then demand finger print the gun should clear your name or atleast stand you with a 50/50 chance. i got off a court case because i was supposed to have been seen at a crime by wittnesses and they said yes it was him the judge asked what was he wearing?? they all said brown leather jacket blue jeans basball cap the police came round the house with in 10 minutes to arest me just enough time to change my clothes and dump them in nextdoor rubbish bin.

anyway in court my solicitor pointed out that i do not own a leather jacket never mind a brown one and why did the police not do a search for the so called leather jacket at the time of the arest? *police officer looks dumb as fuck in the dock* they play the video of me walking in to the police station waring addids bottoms and a blue puffer jacket LOL judge get out of my court room and dont bring this sort of thing before me again! CPS 0 - big bud 1

what im getting at for you is play the i did not know it was there and if the police did not take finger prints then this could fuck the case up for them at the end of the day they have to prove its yours although 9 -10th's of the law is possession. a good solisitor might beable to swing things around for you by picking up on police fuck ups such as did they finger print the gun as you have said its not yours its your m8's that is a good case for you and the fact is finger prints should have been take because your defence depends on it.

I think I've found a loop hole, I've been thinking my ass of this whole time.
They just barged in my house, in the cop car I asked to see a warrant, they refused it upon me, I didn't think anything of it at the time, but isn't it in my rights for them to provide me with a copy of it to see?
Can't I get off the hook if they didn't supply such info?

Also, are you on probation for a felony or a misdemeanor? If it's a felony, you're SOL for a good while...
