  • A Trump-appointed judge was unclear on a number of key issues related to his lawsuit over the Mar-a-Lago search.
  • Judge Aileen Cannon ordered Trump's lawyers to elaborate by Friday on the "precise relief" they seek.
  • Legal experts previously panned Trump's lawsuit and said it lacked fundamental elements.
A day after Donald Trump sued to stop the Justice Department from reviewing records seized at Mar-a-Lago, a federal judge appeared to join other legal experts in their bafflement over what specifically Trump was looking for.

Trump's lawsuit was widely scorned by former federal prosecutors and other legal scholars, who said the filing was lacking fundamental elements, such as exhibits, sworn affidavits, or a viewpoint on how a judge should approach the issues raised.

In interviews and on social media, legal experts said the lawsuit was more akin to a press release with the way it aired Trump's grievances against the Justice Department and described the former president as the "clear frontrunner" in the 2024 Republican primary.

On Tuesday, Judge Aileen Cannon, who was appointed to the bench by Trump and confirmed in 2020, seemed equally unsure of what to make of his lawsuit. Cannon asked the former president's lawyers to further explain what they wanted and how they believed the court should approach their request.

The judge ordered Trump's lawyers to respond by Friday with a court filing "further elaborating" on several points, including the "asserted basis for the exercise of this court's jurisdiction," "the framework applicable to the exercise of such jurisdiction," and the precise relief they want.

Cannon also asked Trump's legal team to address "the effect, if any," of a separate proceeding before Magistrate Judge Bruce E. Reinhart, who approved the warrant allowing the FBI to search the former president's South Florida estate.

"It's never a good sign when within 24 hours of filing a motion a friendly judge issues an order demanding you submit more information on why exactly you brought the matter to her in the first place," wrote Bradley Moss, a national security lawyer.

Trump claims he needs White House records back so he can eventually add them to his presidential library …

  • Donald Trump filed a motion on Monday to have a "special master" review materials seized by the FBI.
  • Trump also demanded the documents be returned so that he can give them back to the National Archives.
  • The National Archives previously asked for the files before the agency approached the DOJ around February.
Donald Trump asked for all documents taken from his Mar-a-Lago home to be returned “ so that he can give the files back “ to the National Archives and Records Administration, while also claiming they will be needed again later for his presidential library.

I don’t think Trump understands the term “Presidential Library”. When he builds one he can ask for the records from NARA, but in the meantime the shelves in his personal office at Mar-a-Lago do not count as a “Presidential Library”. Here is an odd Hollywood meets Reality Moment.

‘Something is different’ as Trump faces legal battle outside of presidency: NYT

Donald Trump is facing a precarious legal situation as his classified document scandal continues to look worse with every new revelation, The New York Times reported on Tuesday.

"Mr. Trump has projected his usual bravado, and raised millions of dollars online from outraged supporters, since federal agents descended on the property more than two weeks ago and carted off boxloads of material including highly classified documents," Maggie Haberman, Glenn Thrush, and Alan Feuer reported. "But something is different this time — and the errant court filing offered a glimpse into the confusion and uncertainty the investigation has exposed inside Mr. Trump’s camp."

Late on Monday, Trump's team revealed an incriminating letter from the National Archives and Records Administration (NARA) sent in May.

"The documents investigation represents the greatest legal threat Mr. Trump has faced in years, and he is going into the battle shorn of the protective infrastructure and constitutional armor of the presidency. After years of burning through lawyers, he has struggled to hire new ones, and has a small group of lawyers of varying experience," The Times reported. "He is facing a Justice Department he no longer controls, run by a by-the-book attorney general, Merrick B. Garland, who has pursued various investigations into Mr. Trump methodically and quietly. Mr. Trump is serving as his own communications director and strategic adviser, seeking tactical political and in-the-moment public relations victories, sometimes at the risk of stumbling into substantive legal missteps."

Trump is going into this battle without the protections of the presidency.

"Now, as in the days after he lost the 2020 election, Mr. Trump is relying on an ad hoc team of advisers with varying levels of experience and judgment, and trying to use his political support as both a shield and a weapon to be aimed at the people investigating him," the newspaper reported. "But even as he fuels outrage in sympathetic media outlets and tries to turn attention to Mr. Biden and the so-called deep state, Mr. Trump is to some extent walking on the phantom limbs of his expired presidency, claiming executive privilege still applies to him even though he’s out of office and maintaining he had a sweeping, standing order to declassify some documents, which his aides have declined to produce."

Trump is also experiencing a shrinking inner circle.

"Mr. Trump’s court filing on Monday requesting the special master to review the seized documents was styled as a legal motion, but it sounded more like a news release drafted by Mr. Trump himself," the newspaper reported. "His concentric circles of political advisers, several layers deep when he held power, are also shrinking. Mr. Trump is thinly staffed as he sits at his private club at Bedminster, N.J., or at Trump Tower in New York City for the summer, and sometimes makes decisions without keeping his close advisers in the know."

Oh so you only like big money in politics if it means democrats are winning. Makes sense.
That's another predictable action by you. Where did I say that? Go back and re-read my post. I said a former Democrat is selling out to a wealthy Republican who is using her to split the Democratic vote and give Republicans a chance for the first time in decades. That's just a plan fact. It is a neutral statement. She can't win. But she can help a Republican win. Even with Phil Knight's millions in contributions, the race was rated at most a toss up for Republicans. And THAT was before Republicans took away women's reproductive rights. As I said, come back in October when people start paying attention to the candidates.

So, let's go back to the weasel words you posted:

Aren't you about to have a Republican governor for the first time in quite a while in Oregon? Doesn't that kinda debunk your "theory" on a local very personal level? Just walk around your community and acknowledge how half of them think that everything you say is pure nonsense.

What an ignorant statement. You may thank me now for educating you.

Justice matters, but so do the midterm elections, so justice can wait a bit longer.

Donald Trump's personal handling of stolen classified documents increases odds he will be prosecuted
94,492 views Aug 23, 2022 The New York Times has reported that "Trump had more than 300 classified documents at Mar-a-Lago." But that wasn't even the most damning revelation by the Times. The new reporting also includes the following: "Mr. Trump went through the boxes himself in late 2021."

Federal prosecutors like to bring strong cases. One of the challenges of prosecuting someone for mishandling classified government documents is proving that they actually "handled" the documents.

This video explains the difference between the legal concepts of "actual possession" and "constructive possession," and discusses why prosecutors are far more comfortable bringing cases that involve actual possession. Given this New work Times reporting, prosecutors will clearly be able to prove that Donald Trump actually POSSESSED the documents that had been unlawfully removed from the White House and concealed at Trump's Florida home.

This important development undeniably increases the odds that Trump will be indicted for his crimes.

I think Betsy will leech votes from what might be called the moderate right in Oregon

I sure hope they don't bust Trump too soon, use him to win the election, because only by winning the election can you hope to address the real problems that brought you Trump and preserve liberal democracy.

New Reporting Outlines Trump's 'Willful' Retention Of Classified Docs
3,733 views Aug 23, 2022 “The barrage of facts we have gotten since the search at Mar-a-Lago has shown how almost obsessively, single-mindedly willful this was," says Chris Hayes. "He decided they were his, he tried to hide them and to keep them after being repeatedly instructed to return them.”
