Need help with Nevada home cultivation law (cultivating strains that dispensaries don't have)

I submitted my application at the state office in carson city and was told in writing that I can grow 12 plants since I live more than 25 miles from a dispensary and this was on 05/18/2016. this came directly from the agency that issues MMJ cards my application asked if I planed to grow my medicine and asked for a reason why I was growing my own medicine. if the law has changed and patients are not allowed to grow their own medicine than the state health department and the division of public and behavioral health are unaware of this change and they are the people that run the program.I have read several accounts of law enforcement harassing MMJ card holders and even raiding their homes and seizing their property which is a violation of article 4 section 38 subsection (c) of the state constitution but no one has been convicted when they were in compliance with NRS 453a.200 section 3 of state law.apparently law enforcement does not support MMJ and is willing to step outside the law in order to harass patients

Are you talking about the people years ago that were raided for runnin those shady "walk in" dispensaries? Our state was Not set up for the sale of marijuana at that time all the people who were doing that and got raided had to know they were doing somthing that could get them in trouble with the law and if they didn't theyr morons...not saying I agree with what happened but at that time it was definatly somthing that wasn't protected by any law or licensing...if your just growing 12 plants for yourself there is no reason for them to fuck with you, and they won't that's a promise

Thanks for sharing your experience. I guess I don't have to worry unless they put a dispensary in Carson City then I'm 15 miles away. However I did "hear" that if you are poor or on a fixed income you can still grow. Still it sounds as if you need to keep your head down (I'm trying to be an expert) and stay stealthy. It helps when you're an old man without hair or tats and look like a retired cop. Profiling is still one of LE's biggest helper.

http://wrightlawgroupnv.com/police-...rijuana-patients-privacy-rights-in-las-vegas/ this case involved an individual who was not selling MMJ. a local doctor is warning people about police showing up at the homes of MMJ card holders asking to inspect their homes to make sure they are in compliance with the law. the state law is vague in the protection that it offers and the government is very reluctant to give up any power they gained under the drug war.you won't get convicted of possession if you are in compliance with the law but you may still have to defend yourself in court.it may be difficult for some people to resist when 4 angry armed men show up at your door demanding to inspect your grow.remember rampart or rodney king?some agencies behave like this is a police state.

I'm 59 years old with arthritis.even if they put a dispensary in carson city only a limited number of strains will be available.popular medical strains that relieve pain.and lower blood pressure. at very low dosage and contain high levels of CBD and CBN and last a long time in those small dosages like SSH are not available at the 2 dispensaries that have opened in nevada. the people I talked to at division of public and behavioral heath are very supportive of MMJ so it should not be hard to get permission to grow your own based on the claim that the strain you use is not available at the dispensary.you just need to do your homework and find the strain that works best for your condition. the 4th amendment give you a great deal of protection in your own home and state law prohibits judges from using your status as a card holder as probable cause for a warrant. knowing the law (NRS 453A) is your best protection.the law also allows you to grow if no dispensaries were open within 25 miles of your home on the day you filed your application. living 2 miles from the state office that runs this program does have certain benefits.I grow my girls in 2 closets inside my home under fluorescent lights next to my furnace and water heater. (no unusual heat signature) and even my neighbors do not know that i'm an MMJ patient.keep it discreet and stay safe.
 
personally I think the law is complete bullshit I moved to Vegas about 4 years ago when it was "grow your own state" then they sit around with there dicks in there hands over dispensaries for what 12+ years? and then they expect people to just stop all of the sudden with all the money I've invested into my grow equipment, blood, sweat, and tears sure does make moving look better and better when its 100+ outside on top of all the other bullshit
 
FYI- Sierra State Wellness is opening in August in Carson City. Their dwelling is up, signs are hung and an opening soon banner is proudly on display.

Not sure if it's advertised on their website just yet. Are you in carson? It's diagonal to the 99 cent store right on the 50.

Also, from what we've been told, the dispensaries opening go by the county, not population. The carson city sheriff is fighting it every step of the way, however...

All growers can now grow on private land as long as it's locked and you are 25 miles from the cartels.
Isn't that racketeering?
That's literally telling people they cant grow tomato or roses because they live within 25 miles ofTrader Joe's!
How the hell does this hold up in court?
I guess because 1. growers have no lobby like the state dispensary cartel. 2. if it is fought, it goes to federal court where u r still screwed.

However, for MMJ holders there's a part of the law that states if they don't sell the strain that you need you can grow up to 6.
Many people here wont get the license though because of the above privacy issues and i believe you cant hold a ccw permit, not worth the %10 off tax from the cartels IMO
Haven't heard of any small timers going to jail over a grow here.

I haven't heard of anyone being busted here for illegal growing but I don't get out much. I was a MMJ card holder since 2006 but dropped out of the program due to the fact their data base was hacked so I said fuck it and just kept growing my medical weed without a card. There is still a defense you can use in court if you have access to an MD to testify or confirm your need for weed. Fucking bud is so expensive and crappy here you can't afford to buy it and then it doesn't satisfy you craving for full spectrum homegrown. The state requirements says it must be dried down so far it ruins the terpene profiles.

As far as the halo rule thing, I think it's waiting for a court challenge. Give it a few years and hopefully it will go away. Right now I still think the state is making out good so they're not worried about a little guy growing a few plants since the tourists are the ones paying black market prices.

Ya...it seems like the issue for them is to protect dispensary biz. And the 12 plant count says "adult' so having some seedlings and clones shouldn't mess with your numbers. Happy growing and good luck on the slots...

I quit playing slots years ago. Won some jackpots and ate buffets (got fat) the first few years living here but it gets old. Now I only have one obvious addiction.bongsmilie

Growing it makes you more addicted IMO cause you smell it, see it, around it all the time etc.
